Special City Council Meeting – February 16, 2023

A Special Meeting of the San Clemente City Council was called to order by Mayor Duncan on February 16, 2023 at 2:30 p.m. in the City Council Chambers, located at 910 Calle Negocio, 2nd Floor, San Clemente.

PLEDGE OF ALLEGIANCE
Brad Malamud led the Pledge of Allegiance.
1. ORAL COMMUNICATIONS
None.
2. CLOSED SESSION
Closed Session Item A.
Brad Malamud, voiced concern that he did not receive City Attorney proposals in advance of Closed Session; urged Council to select contractors that will serve under most favored nations provision; suggested Council allow for minutes to be taken in Closed Session.
Closed Session Item B.
Brad Malamud, opined that the use of Government Code Section 54957.6 in Closed Session Item B is incorrect; suggested that Council is holding serial meetings which violate the Brown Act.
MOTION BY COUNCILMEMBER JAMES, SECOND BY MAYOR PRO TEM KNOBLOCK, CARRIED 5-0, to remove Closed Session Item B from the agenda.
B. CONFERENCE WITH LABOR NEGOTIATORS
Pursuant to Government Code section 54957.6

MOTION BY COUNCILMEMBER JAMES, SECOND BY COUNCILMEMBER CABRAL, CARRIED 5-0 to recess to Closed Session at 2:39 p.m., to discuss the following:
A. PUBLIC EMPLOYEE APPOINTMENT
Pursuant to Government Code section 54957(b)(1)

3. CLOSED SESSION REPORT – CITY ATTORNEY
No reportable action was taken during Closed Session.
4. ADJOURNMENT
By unanimous vote, Council adjourned at 5:50 p.m. The next Regular Council Meeting is scheduled to take place on February 21, 2023. Closed Session will begin at 5:00 p.m. and the Regular Business Meeting will begin at 6:00 The meeting will take place in the Council Chambers, located at 910 Calle Negocio, 2nd Floor, San Clemente.
