SIXTH AMENDMENT TO THE
PROFESSIONAL SERVICES AGREEMENT FOR
ON-CALL (AS-NEEDED) BUILDING PLAN CHECK SERVICES AND
BUILDING CODE INSPECTION SERVICES
This Sixth Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services is made and entered into on this _____ day of ______, 2023, by and between the CITY OF SAN CLEMENTE, a California municipal corporation (“City”), and West Coast Code Consultants, Inc. (“Contractor”).
R E C I T A L S:
A. City and Contractor entered into that certain Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “Original Agreement”) on May 14, 2019.
B. City and Contractor entered into that certain First Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “First Amendment”) on August 20, 2019.
The Original Agreement, as modified by the First Amendment, is hereinafter referred to as the “Agreement.”
C. City and Contractor entered into that certain Second Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “Second Amendment”) on August 18, 2020. The Original Agreement, as modified by the First Amendment and the Second Amendment, is hereinafter referred to as the “Agreement.” D. City and Contractor entered into that certain Third Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “Third Amendment”) on July 20, 2021. The Original Agreement, as modified by the First Amendment, Second Amendment, and Third Amendment is hereinafter referred to as the “Agreement.” E. City and Contractor entered into that certain Fourth Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “Fourth Amendment”) on January 18, 2022. The Original Agreement, as modified by the First Amendment, Second Amendment, Third Amendment, and Fourth Amendment is hereinafter referred to as the “Agreement.”
F. City and Contractor entered into that certain Fifth Amendment to the Professional Services Agreement for on-call (as-needed) building plan check services and building code inspection services (the “Fifth Amendment”) on May 3, 2022. The Original Agreement, as modified by the First Amendment, Second Amendment, Third Amendment, Fourth Amendment, and Fifth Amendment is hereinafter referred to as the “Agreement.”

G. City and Contractor desire to amend the Agreement in the manner provided herein below.
C O V E N A N T S:
Article 3.1 of the Agreement is hereby amended by increasing the not to exceed compensation amount from Three Hundred Eighty-Five Thousand ($385,000) to Four Hundred Eighty-Five Thousand ($485,000).
Except as expressly amended by this Sixth Amendment, the remaining portions of the Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Sixth Amendment to be duly executed on the respective dates set forth opposite their signatures.
