The estimated repairs cost of $125,560 is provided from in the Disaster Relief Fund. There is adequate funding for this expenditure.
Summary:
Staff recommends approval of a construction contract with O’Connell Engineering and Construction, Inc., in the amount of $98,460 for Richard T. Steed Park Slope Erosion Repairs.
Background:
On January 25, 2023, Public Works was notified of an eroded slope behind the ballfields, west of Calle Extremo, in the Richard T. Steed Park (as shown on Attachment 1). This erosion occurred during recent heavy rains and requires immediate repairs. Due to the urgency of the repairs, staff contacted three contractors that are currently working for the City and are performing satisfactorily. A site visit was conducted and a bid package was provided thereafter to these contractors. Staff received bids on January 30, 2023. O’Connell Engineering and Construction, Inc. of Winchester, California, and Diamond Construction and Design of La Habra, California provided bids in the amount of $98,460 and $253,598, respectively.
The lowest responsive bidder was O’Connell Engineering and Construction, Inc. at $98,460. Based on the low base bid, the repairs cost is estimated as follows:
Soils Testing and Inspection $ 17,300
Construction Contract 98,460
Contingency (10%) 9,800
Total Estimated repairs Cost $125,560
As required by City Policy and State Law, the Contractor will be required to provide performance and payment bonds simultaneously with execution of the construction contract (Attachment 2). Project plans and specifications are on file in the City Clerk's Office.

1. Make a finding that an emergency exists in providing erosion repairs on the slope adjacent to the ball fields at the Richard T. Steed Park to potentially prevent or mitigate impairment to property and public services that might otherwise occur if required to incur delays attributed to the typical engineering design and public competitive bidding process; and
2. Approve, and authorize the Public Works Director/City Engineer to execute, Contract No. C23- 07, by and between the City of San Clemente and O’Connell Engineering and Construction, Inc., providing for the Richard T. Steed Park Slope Erosion Repairs, in the amount of $98,460, Project No. 12161.
