Approximately two weeks ago, City staff received a new application for an Administrative Encroachment Permit for use of the street right-of-way area located in front of 27001 Paseo Activo. This application was accompanied by a copy of an issued Building Permit from the City of San Juan Capistrano for proposed improvements on the 27001 Paseo Activo property.
As you are aware, you have an Administrative Encroachment Permit for use of the street right-of-way in front of an unimproved portion of 27001 Paseo Activo (i.e., "City Property"). Your Administrative Encroachment Permit conditionally allowed construction of landscaping, irrigation, lights, and fence improvements, etc. (i.e., "Owner's Improvements") on the City Property.
Due to the proposed improvements and use of the 27001 Paseo Activo property, the City will hereby be enforcing Covenants 2, 5, and 6 of your Administrative Encroachment Permit, and are hereby Terminating the Agreement. Termination of the Agreement will also trigger the three weeks advance notice for removal of the "Owner's Improvements" as defined in your Administrative Encroachment Permit. Per the Agreement, you are responsible for removing said improvements and restoring the City Property. Removal of the Owner's Improvements shall be completed by December 7, 2022.
