RESOLUTION NO. 23-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO PREPARE AND EXECUTE THE FIRST AMENDMENT TO THE PROFESSIONAL CONSULTANT SERVICES AGREEMENT BETWEEN PRECISION CIVIL ENGINEERING, INC. AND THE CITY OF SAN CLEMENTE FOR PLANNING CONSULTING SERVICES TO IMPLEMENT THE HOUSING ELEMENT REZONING PROGRAM WHEREAS, on September 20, 2022, the City Council adopted the Housing Element Update in accordance with state law and before the state’s deadline of October 16, 2022; and WHEREAS, on October 3, 2022, the interim City Manager authorized an initial Professional Services Agreement with PCE for $50,000, the amount of the City Manager’s contract authority, to start work on the Housing Element Rezoning Program (the “Agreement”); and WHEREAS, on October 12, 2022, the Department of Housing and Community Development (HCD) certified the City’s Housing Element; and WHEREAS, the original Agreement of $50,000 served to begin the work at the end of last year and meet the state mandated deadline; and WHEREAS, an amendment to the Agreement is needed to capture the remaining scope of work by increasing the contract amount to an amount not to exceed $104,000, for a total increase of $54,000; and WHEREAS, this contract amendment for planning services to be completed by Precision Civil Engineering Inc. will assist staff with implementation of the Housing Element Rezoning Program and is in the public’s interest.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1.
The above recitals are considered findings by the City Council and incorporated into the body of this resolution.
Section 2.
The City Manager is hereby authorized and directed to prepare and execute an Amendment to the Professional Service Agreement with Precision Civil Engineering Inc. to provide planning consulting services to implement the Housing Element Rezoning Program to increase the not to exceed contract amount to $104,000 in substantially the same form as the amendment attached to this Resolution as Exhibit “A” and incorporated herein fully by this reference.
Section 3. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
