RESOLUTION NO. 23-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN CLEMENTE, CALIFORNIA, RATIFYING EMERGENCY
CONSTRUCTION CONTRACT WITH VORTEX INDUSTRIES,
LLC FOR REPLACEMENT OF INDUSTRIAL DOOR AND
OPERATOR AT WATER RECLAMATION PLANT
WHEREAS, the City of San Clemente operates a Water Reclamation Plant (WRP) to treat wastewater, and dewatered biosolids are produced as a result of the wastewater treatment process which are hauled away to a fertilizer facility for beneficial reuse; and WHEREAS, failure of one of the industrial doors and operator at the biosolids truck loading bay caused an emergency situation in that one of the loading bays could not be accessed to load biosolids to be hauled away; and
WHEREAS, the inability to access both biosolids loading bays could have had a negative impact on health and safety as biosolids removal was reduced and could have caused a violation of the City’s wastewater permit; and WHEREAS, staff obtained an informal quote for an emergency replacement of the door and operator from Vortex Industries, LLC, a contractor that has performed similar work for the City, filed a notice of exemption for the work and entered into an emergency contract for the work.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1. The City finds and determines that an emergency existed due to the failure of the industrial duty rolling steel door and operator at the WRP that required immediate action to protect health and safety and maintain permit compliance, which might not have been possible to maintain if delays attributable to the typical engineering design and public competitive bidding process had been incurred.
Section 2. The City declares that the public interest and necessity demanded the immediate expenditure of public funds to safeguard public health.
Section 3. The City Council ratifies the Emergency Construction Contract entered into with Vortex Industries, LLC for replacement of the inoperative door and operator at the WRP.
Section 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
