RESOLUTION NO. 23-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT AGREEMENT TO ONYX PAVING COMPANY, INC. TO PERFORM CONSTRUCTION OF FY 2023 AS-NEEDED PAVEMENT REPAIRS (TRACT 852), AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 2 (REPLACEMENT OR RECONSTRUCTION, 14 CCR SECTION 15302) OF THE STATE CEQA GUIDELINES WHEREAS, the City conducted formal competitive bidding for the FY 2023 As-Needed Pavement Repair (Tract 852), Project No. 23306 (Project); and WHEREAS, on May 18, 2023, the City received 5 bids ranging from $515,000 to $1,014,321 for the Project; and WHEREAS, the ONYX Paving Company, Inc. was the lowest responsive bidder with a bid of $515,000.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolves as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 2 (Replacement or Reconstruction, 14 CCR section 15302) of the State CEQA Guidelines because it consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.
SECTION 3. That the Construction Contract Agreement for the FY 2023 As-Needed Pavement Repairs (Tract 852), Project No. 23306 is awarded to ONYX Paving Company, Inc.
SECTION 4. That the City Manager is authorized and directed to execute a construction contract for the FY 2023 As-Needed Pavement Repairs (Tract 852), Project No. 23306 with ONYX Paving Company, Inc. in an amount not to exceed $515,000, plus a 10% project contingency of $51,500, in a form substantially similar to that presented to City Council on June 6, 2023.
SECTION 5. That the City Council authorizes the fund transfer in the amount of $690,000 from account number 042-848-45300-000-13326 FY 2023 Alley Pavement Rehabilitation, Project No. 13326 to account number 042-848-43420-000-23306 FY 2023 As-Needed Pavement Repairs (Tract 852), Project No, 23306.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
