RESOLUTION NO. 23-60

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE CITY

MANAGER TO PREPARE AND EXECUTE A CONTRACT

WITH LAZ PARKING CALIFORNIA, LLC TO CONTINUE

EXPANDED GREEN LINE TROLLEY OPERATIONS,
APPROPRIATING $201,600 FOR FUNDING AND FINDING

THE PROJECT CATEGORICALLY EXEMPT FROM THE

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION
15301) OF THE STATE CEQA GUIDELINES
WHEREAS, the City of San Clemente Mission Statement states, “… Maintaining a safe, healthy atmosphere in which to live, work and play…”; and WHEREAS, the City Council has determined it is in the best interest of the community to execute a contract to continue expanded local transit services in the City; and WHEREAS, LAZ Parking California, LLC (“LAZ”) operates the existing Project V Local Transit Trolley program in the City of San Clemente; and WHEREAS, City Council Policy 201-2-8, Selection of General Services Consultants and Contractors, allows for exemptions to the standard bidding procedures to allow for direct selection of contractors in situations where such selection is in the public interest; and WHEREAS, selection of LAZ will allow for expanded trolley operations for the duration of the summer season, which has already begun; and WHEREAS, LAZ has unique knowledge of the City’s transit program and is familiar with the oversight of the Orange County Transportation Authority (OCTA) and the reporting requirements of OCTA; and
WHEREAS, it would be infeasible to operate one trolley system with multiple distinct operators, which would cause scheduling and integration problems for the ongoing trolley services in San Clemente; and
WHEREAS, direct selection of LAZ to continue expanded local transit services in the City from July through September, 2023 is in the public interest.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:

Section 1.

The above recitals are considered findings by the City Council and incorporated into the body of this resolution.

Section 2.

This project is determined to be categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15301 (Class 1: Existing Facilities, 14 CCR §15301) because it involves the use of existing roadways and transit stops to provide additional local transit options, and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.

Section 3.

The City Manager is hereby authorized and directed to prepare and execute a contract for services with LAZ Parking Inc. to return the Green Line to service, operating daily to reflect the Red and Blue Line trolley operations from July through September, 2023 in the City of San Clemente in an initial amount not to exceed (emphasis added) $201,600 in a form acceptable to the City Attorney that can be modified as needed in the City Manager’s discretion (with the exception of the not to exceed amount).

Section 4.

The contract shall indicate the specific services to be provided, but in general, the transit services are intended to augment the existing Project V Trolley program.

Section 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

PASSED AND ADOPTED this 20th day of June, 2023.
