RESOLUTION NO. 23-49
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A PROFESSIONAL SERVICES AGREEMENT (PSA) TO KIMLEY-HORN AND ASSOCIATES, INC. FOR CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) REVIEW SERVICES IN CONNECTION WITH THE BLUFFS AT BOCA PROJECT AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WHEREAS, on June 24, 2020 an application for development on seven lots located at 320-326 La Rambla and 312-314 Boca Del Canon was submitted by the Applicant; and WHEREAS, in February 2021, the Applicant retained the services of a private consulting firm to begin the preparation of environmental documentation for the project; and WHEREAS, on November 10, 2022, a Notice of Preparation for the Draft EIR was filed and on November 30, 2022 a public scoping meeting was held at City Hall; and WHEREAS, on February 8, 2023, the Planning Division posted a Request for Proposals (RFP) soliciting proposals from qualified firms to provide third-party consultant review services for an Environmental Impact Report (EIR) and related technical documents prepared in accordance with the California Environmental Quality Act (CEQA) for the Bluffs at Boca project; and WHEREAS, on April 13, 2023 and April 17, 2023, the Planning Division conducted consultant interviews of three qualified environmental firms which submitted proposals in response to the RFP; and WHEREAS, on April 18, 2023, the Planning Division convened to discuss the consultant interview; and WHEREAS, Kimley-Horn & Associates, Inc. best demonstrated the expertise necessary to manage the EIR review process at a fair and reasonable cost.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1. Recitals. The above recitals are considered findings by the City Council and incorporated into the body of this resolution.
Section 2. CEQA Findings. The selection of a consultant to conduct review of environmental documents is not a project under CEQA.
Section 3. Based on the foregoing recitals and findings, and the written and oral comments, facts, and evidence presented, the City Council of the City of San Clemente, California awards a Professional Services Agreement to Kimley-Horn & Associates, Inc. as the City’s review consultant of environmental documents for the Bluffs at Boca project.
Section 4. The City Manager is hereby authorized and directed to execute a Professional Service Agreement with Kimley-Horn and Associates, Inc. to provide CEQA environmental review services in connection with the Bluffs at Boca project for a not to exceed contract amount of $54,903 in a form substantially similar to that attached to this Resolution as Attachment 1 and incorporated herein fully by this reference.
Section 5. Certification. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
