RESOLUTION NO. 23-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING THE UPDATE TO THE SPILL EMERGENCY RESPONSE PLAN SECTION OF THE CITY OF SAN CLEMENTE SANITARY SEWER MANAGEMENT PLAN, AS REQUIRED BY RECENT CALIFORNIA STATE WATER RESOURCES CONTROL BOARD ADOPTED ORDER NO. 2022-0103-DWQ, AUTHORIZING THE CITY MANAGER AND UTILITIES MANGER TO APPROVE ANY FUTURE MINOR UPDATES AS NEEDED AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 8 (ACTIONS BY REGULATORY AGENCIES FOR THE PROTECTION OF THE ENVIRONMENT), SECTION 15308 OF THE STATE CEQA GUIDELINES WHEREAS, the California State Water Resources Control Board recently adopted Order No. 2022-0103-DWQ, which requires amendments to the City’s Sanitary Sewer Management Plan to include the Spill Emergency Response Plan.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. The foregoing recitals are true and correct and incorporated herein.
Section 2. This project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 8 (Actions by Regulatory Agencies for Protection of the Environment, 14 CCR section 15308), Section 15308 of the state CEQA Guidelines because they consist of actions taken by regulatory agencies, as authorized by state law, to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment.
Section 3. The Spill Emergency Response Plan, as presented to City Council on July 18, 2023, is hereby approved and adopted.
Section 4. The City Manager and Utilities Manager are authorized to approve any future minor amendments to the Spill Emergency Response Plan as mandated by the State Water Resources Control Board, regarding the Sanitary Sewer Management Plan, Sanitary Sewer Overflow Prevention Plan and Spill Emergency Response Plan.
Section 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
