RESOLUTION NO. 23-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING FINAL PARCEL MAP 2021-160, LOCATED AT 162 AVENIDA FLORENCIA WHEREAS, the property owner and subdivider, Hallie Levy Lecompte, owns an existing two-unit apartment building located at 162 Avenida Florencia; and WHEREAS, the subdivider applied for a Tentative Parcel Map in order to subdivide the two-unit apartment building into two condominiums; and WHEREAS, the Tentative Parcel Map 2021-160 was approved by the Zoning Administrator on May 5, 2022 through Resolution ZA 22-003; and WHEREAS, Resolution ZA 22-003 included Conditions of Approval for the subdivider to obtain California Coastal Commission approval for the proposed Final Parcel Map, City Attorney approval of Conditions, Covenants and Restrictions (CC&Rs), and to obtain from all persons having any interest in existing rights of way for pipelines for the conveyance of water and the rights to all underground water; and WHEREAS, the subdivider has satisfied all the Conditions of Approval (or will satisfy them with the recording of the Final Parcel Map) and offered to the City all water rights as dedicated; and WHEREAS, this project was previously found Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301.k (Class 1: Existing Facilities) in connection with the approval of the Tentative Parcel Map; and WHEREAS, pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications; and WHEREAS, the Final Parcel Map 2021-160 substantially conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. The San Clemente City Council hereby approves Final Parcel Map 2021-160 as it conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map.
SECTION 3. The San Clemente City Council hereby accepts on behalf of the City of San Clemente the water rights as dedicated on Final Parcel Map 2021-160.
SECTION 4. That the Public Works Director/City Engineer is authorized to execute the Final Parcel Map.
SECTION 5. That the City Clerk is authorized to sign and submit the Final Parcel Map for recordation with the County of Orange Recorder’s Office.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
