MASTER PLAN AMENDMENT - SAN GORGONIO PARK AND FINDING THE AMENDMENT

CATEGORICALLY EXEMPT FROM THE
..body CALIFORNIA ENVIRONMENTAL QUALITY ACT
Fiscal Impact:

The resurfacing of one court at San Gorgonio Park is estimated to cost $32,500. This will provide for the repair of the surface of the existing post-tension slab, the court striping/painting, and the cost of tennis netting, benches, and signage, as needed. The project will be funded through the existing Parks - Maintenance budget.

Summary:

The pickleball courts at San Gorgonio Park were closed on November 7, 2023, based on Council direction. An amendment to the San Gorgonio Park Site-Specific Master Plan (“Master Plan”) to remove pickleball as an allowed use for these courts would make the closure permanent and ensure that pickleball is not played on the tennis courts and would allow enforcement action if pickleball occurs. Council can further consider amending the Master Plan to remove pickleball as an allowable use on one court (identified as Court #2 in Attachment 3), thereby allowing for pickleball to continue on Court #2, as a transitional use, and restricting the remaining court (identified as Court #1 in Attachment 3) to tennis only.

Background:

On November 7, 2023, the pickleball courts were closed and all pickleball play was relocated to Richard T. Steed Memorial Park at the new 8-court pickleball facility.

At its meeting on Tuesday, November 7, 2023, the City Council continued the public hearing on this matter and directed staff to provide an option that considers maintaining the play of pickleball on one court on a transitional basis.

Council Options:
 Adopt Resolution No. 23-132, amending the San Gorgonio Park Site-Specific Master Plan to eliminate pickleball as a designated use for one court, identified as Court #1, and return the area to a tennis court, approve of staff moving forward to complete the tennis court resurfacing project on Court #1, and finding the actions categorically exempt from the California Environmental Quality Act under 14 CCR Section 15302 (Class 2: Replacement or Reconstruction) and 14 CCR Section 15301 (Class 1: Existing Facilities) of the State CEQA Guidelines.
1 Meeting Date: November 9, 2023 Agenda Item: 1A

CITY OF SAN CLEMENTE
 Adopt Resolution No. 23-130, amending the San Gorgonio Park Site-Specific Master Plan to remove pickleball as a designated use for the courts at the northwest side of the Park and return those courts to two permanent tennis courts, approve of staff moving forward to complete the tennis court reconstruction project, and finding the actions categorically exempt from the California Environmental Quality Act under 14 CCR Section 15302 (Class 2:

Replacement or Reconstruction) of the State CEQA Guidelines.  Modify and adopt the Resolution.
 Continue the Item with direction(s) given to staff related to the use of the subject court area at San Gorgonio Park.
 Deny the Resolution.

Environmental Review/Analysis
Resurfacing the court(s) and the amendment to the San Gorgonio Park Site-Specific Master Plan changing from pickleball to tennis courts are actions that are categorically exempt from the California Environmental Quality Act under 14 CCR Section 15302 (Class 2: Replacement or Reconstruction) of the State CEQA Guidelines because they consist of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, and under 14 CCR Section 15301 (Class 1: Existing Facilities).

Recommended Actions:

Staff Recommendation ..recommendation
Staff recommends the City Council adopt Resolution No. 23-132, which will:

1. Find that converting one court to tennis use only and amending the San Gorgonio Park Site-Specific Master Plan to discontinue pickleball upon Court #1 is categorically exempt from the California Environmental Quality Act, 14 CCR Section 15302 (Class 2:

Replacement or Reconstruction) and 14 CCR Section 15301 (Class 1: Existing Facilities) of the State CEQA Guidelines; and

WHEREAS, in 1988, the master plan for San Gorgonio Park was adopted with two tennis courts located at the north west side of the park, identified in Exhibit A hereto which is incorporated by this reference; and
WHEREAS, in 2018, the master plan for San Gorgonio Park was amended to add pickleball as a planned use of the park with four pickleball courts to be established in the court #2 area; and
WHEREAS, in 2019, the City Council approved the conversion of tennis court #2 into four permanent pickleball courts and the dual-lining of court #1 to be used for both pickleball and tennis; and
WHEREAS, at its June 6, 2023 meeting, the City Council adopted Resolution No. 23-47, authorizing the construction of eight temporary pickleball courts at Richard T. Steed Sports Park, and further directing the closure of the pickleball courts in San Gorgonio Park no later than November 7, 2023; and
WHEREAS, an amendment to the San Gorgonio Park Site-Specific Master Plan is required to remove pickleball as a use for court #1 and permanently return the court to the use of playing tennis only.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:

of the State CEQA guidelines because they involve replacing four dual-use pickleball courts with one tennis court and consist of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, and consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The actions will not have any substantial direct or foreseeable indirect effect on the environment.

Section 4. Except as expressly modified by this resolution, San Gorgonio Park Site-Specific Master Plan is not otherwise modified.

Section 5. Staff is authorized and directed to take all steps necessary and proper to proceed with re-establishing the court for tennis use only, including, but not limited to, proceeding with soliciting bids to resurface the court.

CITY OF SAN CLEMENTE

CITY COUNCIL MEETING

CITY OF SAN CLEMENTE
Meeting Date: November 9, 2023 Agenda Item: 1B

CONSIDERATION OF TRANSITIONAL USE OF PICKLEBALL COURTS AT SAN GORGONIO

PARK AND DESIGNATION OF LIMITED-USE GUIDELINES AND FINDING THE ACTIONS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ..body Fiscal Impact:

None.

Summary:

The pickleball courts at San Gorgonio Park are currently closed based upon previous Council direction. In order to provide for some limited transitional use of some of the pickleball courts, the Council must approve their reopening. The purpose of reopening the pickleball courts would be to provide a transitional facility that will allow for beginning/intermediate play with limited hours of operation while city staff and the Beaches, Parks & Recreation Commission consider options for expediting an additional expansion of pickleball within the San Clemente park system.

Background:

At its June 6, 2023, meeting, the City Council directed staff to close the pickleball courts at San Gorgonio Park on or before November 7, 2023, in conjunction with the opening of the new courts at Richard T. Steed Memorial Park.

At its November 7, 2023, meeting, the City Council directed staff to provide a recommendation on hours of operations and conditions for play at four pickleball courts at San Gorgonio Park. Council expressed an interest in considering reducing pickleball use during peak park usage and utilizing the courts for beginning/intermediate players and/or lessons.

Staff recommends the Council consider the following operational structure and conditions for play on the transitional pickleball courts at San Gorgonio Park:
 Weekday play (Monday-Friday), 9 a.m. to 4 p.m.
 Play will be managed through a rotation system with no challenge court, therefore providing for beginning and intermediate play only.
 City lessons will be offered at this site to encourage beginner play.

The hours of operations detailed above will be applied to the tennis court facility as well due to the setup of the court facility.
1 Meeting Date: November 9, 2023 Agenda Item: 1B

CITY OF SAN CLEMENTE
It is further recommended that these courts be established on a limited/transitional basis while the City evaluates options to permanently construct additional courts at either Richard T. Steed Memorial Park or against the freeway at San Gorgonio Park. With Council direction, staff intends to bring an item to the Beaches, Parks and Recreation Commission meeting at its next regularly scheduled meeting to consider these options.

Council Options:
 Adopt Resolution No. 23-133, directing staff to re-open four pickleball courts at San Gorgonio Park on a transitional basis under specific use parameters of weekdays only, 9 a.m. to 4 p.m., with no challenge court, and directing the Beaches, Parks & Recreation Commission to consider options for expediting future pickleball facility expansions and establishing revenue sources within the existing court system, and finding the actions categorically exempt from the California Environmental Quality Act under 14 CCR Section 15301 (Class: Existing Facilities) of the State CEQA Guidelines.  Modify and adopt the Resolution.
 Continue the Item with direction given to staff related to the rules of play of the pickleball courts at San Gorgonio Park.
 Deny the Resolution.

Environmental Review/Analysis
Establishing use parameters and rules for play upon the pickleball courts at San Gorgonio Park is categorically exempt from the California Environmental Quality Act under 14 CCR Section 15301 (Class 1: Existing Facilities) of the State CEQA Guidelines because the use of the courts is consistent with the approved site plan and will have substantially the same purpose and capacity as the existing purpose.

Recommended Actions:

Staff Recommendation ..recommendation
Staff recommends the City Council adopt Resolution No. 23-133, which will:

1. Direct staff to re-open four pickleball courts at San Gorgonio Park, located on Court #2, on a transitional basis with limited use parameters; and

2. Find that establishing parameters and rules for pickleball court use is categorically exempt from the California Environmental Quality Act, 14 CCR Section 15301 (Class 1: Existing Facilities) of the State CEQA guidelines; and

3. Limit the court operations to weekdays, 9 a.m. to 4 p.m., with no Challenge Court established within the four-court setup; and

WHEREAS, the pickleball courts at San Gorgonio Park were closed on November 7, 2023, in conjunction with the opening of the pickleball courts at Richard T. Steed Memorial Park; and
WHEREAS, the site-specific park master plan for San Gorgonio Park, as amended by Council adopted Resolution No. 23-132 continues to allow for the use of four courts for the play of pickleball at San Gorgonio Park on Court #2; and WHEREAS, at its November 7, 2023, meeting, the City Council directed staff to further consider options for limiting the use of play at the courts by providing reduced hours and parameters of play.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

Section 1. The City Council finds that the above recitations are true and correct.

Section 2. The four pickleball courts located on Court #2 of the courts established on the northwest side of San Gorgonio Park as shown on the attached Exhibit A are to be opened for play on a transitional and limited basis.
