RESOLUTION NO. 23-153
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE INSTALLATION OF TWO PALAPA STRUCTURES AT LASUEN BEACH AND ACCEPTING A DONATION FROM THE FRIENDS OF SAN CLEMENTE BEACHES, PARKS & RECREATION FOUNDATION TO FUND THE PROJECT, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER 14 CCR §15303 (CLASS 3: NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES) OF THE STATE CEQA GUIDELINES WHEREAS, the Friends of the San Clemente Beaches, Parks & Recreation Foundation (“Friends”) has offered to donate the materials necessary for the installation of two palapas at Lasuen Beach; and WHEREAS, the Friends, a not-for-profit corporation, is a partner with the City and is dedicated to supporting services and facilities for the Beaches, Parks & Recreation Department; and WHEREAS, City Policy No. 204-5, entitled “Guidelines for the Acceptance of Donations, Sponsorships, & Gifts”, requires all major donations be considered by the City Council prior to acceptance; and WHEREAS, the donation of new palapas at Lasuen Beach is deemed an enhancement and benefit to beachgoers and is inherently temporary in nature due to their short useful life expectancy.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby finds, determines and resolves as follows:

Section 1. The above recitations are true and correct and incorporated herein.

Section 2. Installing the two palapas is categorically exempt from the California Environmental Quality Act under 14 CCR §15303 (Class 3: New Construction or Conversion of Small Structures) of the State CEQA Guidelines because it consists of the installation of a limited number of small structures that are temporary in nature and have no direct or foreseeably indirect possibility of causing a substantial impact on the environment.

Section 3. The Council authorizes the installation of two palapa shade structures at Lasuen Beach.

Section 4. To fund the cost of this amenity, the Friends has committed a donation of up to $5,000 towards the installation. The Council accepts this donation and authorizes staff to coordinate with the Friends on the installation and location of the palapas and inclusion of the Friends’ logo on the structures. Upon acceptance, the City will take full responsibility for the ongoing maintenance and repairs of the structures. The City makes no commitment to replace the palapas at the end of their useful life.

Section 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
