RESOLUTION NO. 23-149
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, REJECTING ALL THE BIDS FOR THE FY 2024 AS-NEEDED PAVEMENT REPAIRS, CIP PROJECT NO. 24306 WHEREAS, the City conducted formal competitive bidding for the FY 2024 As-Needed Pavement Repairs, CIP Project No. 24306 (Project); and WHEREAS, on October 5, 2023, the City received 5 bids ranging from $596,466 to $1,246,600 for the Project; and WHEREAS, upon further analysis, staff determined that the scope was too broad, did not provide enough focus and clarity on the pavement needs for the City, included work from other trades that should not be included in this project and produced bids that exceeded budget constraints; and WHEREAS, Public Contract Code section 20166 provides that, in its discretion, the legislative body may reject any bids presented and readvertise; and WHEREAS, rejecting all bids, revising the scope of work to focus on asphalt paving needs and to more accurately describe the project so that it will be capable of staying within budget and can be more easily and efficiently managed, and re-bidding the project with a revised scope in early 2024 is in the public’s best interest.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1. That the above recitations are true and correct and incorporated herein.
Section 2. That all bids received on October 5, 2023 for the FY 2024 As-Needed Pavement Repairs, CIP Project No. 24306 are hereby rejected.
Section 3. That staff is authorized to re-scope the bid package and to bid the FY 2024 As-Needed Pavement Repairs, CIP Project No. 24306, with a revised scope.
Section 4. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
