RESOLUTION NO. 23-160
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING REPLACEMENT OF THE SUBSTRATE SURFACING AT SAN GORGONIO PARK PLAYGROUND WITH A CONTINUOUS RUBBERIZED MATERIAL, APPROPRIATING $130,000 FOR THE PROJECT, ACCEPTING A $20,000 DONATION FROM THE FRIENDS OF THE SAN CLEMENTE BEACHES, PARKS & RECREATION FOUNDATION AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER 14 CCR SECTION 15302 (CLASS 2: REPLACEMENT OR RECONSTRUCTION) OF THE STATE CEQA GUIDELINES WHEREAS, the San Gorgonio Park playground was replaced under the regular playground replacement schedule approved by the City Council in 2015, which included engineered wood fiber surfacing; and WHEREAS, the City recevied complaints regarding the playground surfacing at San Gorgonio Park from playground users; and WHEREAS, the City Council desires, and it is in the best interest of the public, to provide a playground surfacing at the San Gorgonio Park playground that is not engineered wood fiber; and WHEREAS, there are limited options available for playground surfacing that are considered to meet the compliance standards for California set by the U.S. Consumer Product Safety Commission (“CPSC”), ASTM International (“ASTM”), and the American Disability Act (“ADA”). Options include EWF, poured-in-place rubber surfacing (“PIP rubber”), rubber mulch, or synthetic turf; and WHEREAS, to aid in the cost of this park amenity replacement, the Friends of the San Clemente Beaches, Parks & Recreation Foundation has committed a donation of $20,000 towards the surface replacement and has requested that its logo be included in the surfacing or recognition be located near the playground area.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the City Council finds that the above recitations are true and correct.
Section 2. That based on substantial evidence in the record as a whole, the project is hereby determined to be categorically exempt from the California Environmental Quality Act under 14 CCR Section 15302, Class 2: Replacement or Reconstruction, of the State CEQA Guidelines because it consists of the replacement/reconstruction of an existing facility where the replacement will be located on the same site as the material to be replaced and will have substantially the same purpose and capacity, and the project will not have a substantial direct or foreseeably indirect effect on the environment.
Section 3. That the Council authorizes the replacement of the engineered wood fiber substrate surface at the San Gorgonio Park playground with a poured-in-place rubber surface with an estimated cost of up to $150,000 for removal and replacement. The Council further approves a supplemental appropriation of $130,000 from the Unassigned Fund Balance to the Park Asset Replacement Account for this project.
Section 4. That the Council accepts the $20,000 donation from the Friends of the San Clemente Beaches, Parks & Recreation Foundation to aid in the cost of this park amenity replacement and authorizes an appropriation of these funds into the Park Asset Replacement Account. Furthermore, City staff is authorized and directed to coordinate with the Foundation on the placement of the Foundation’s logo on or near the playground area in acknowledgment of this donation.
Section 5. That the City Manager, or his designee, is authorized to take such other and further actions as are necessary and proper to accomplish the intent of this resolution.
Section 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
