RESOLUTION NO. 23-140
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AS COMPLETE THE EMERGENCY RESERVOIR 13 ISOLATION VALVE REPLACEMENT, PROJECT NO. 24405 WHEREAS, on October 17, 2023, the City Council adopted Resolution No. 23-118, which ratified an emergency construction contract with O’Connell Engineering for isolation valve replacement at Reservoir 13 in the amount of $96,800 and approved a 15% project contingency in the amount of $14,520; and WHEREAS, the work was an emergency because the valve failure rendered Reservoir 13 non-operational; and WHEREAS, on October 10, 2023 work began on the project; and WHEREAS, on October 18, 2023, O’Connell Engineering & Construction, Inc. completed the emergency Reservoir 13 isolation valve replacement, Project No. 24405, to the satisfaction of the Public Works Director, for a total cost of $110,999.03; and WHEREAS, on October 21, 2023, City staff was able to return Reservoir 13 to functional service.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. The Emergency Reservoir 13 Isolation Valve Replacement, Project No. 24405, is hereby accepted from O’Connell Engineering and Construction, Inc.
SECTION 3. That the Public Works Director/City Engineer is hereby authorized and directed to execute and record the Notice of Completion for the completed Emergency Reservoir 13 Isolation Valve Replacement project.
SECTION 4. That the City Clerk is hereby authorized to release the Payment Bond for Project No. 24405 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, O’Connell Engineering and Construction, Inc.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
