RESOLUTION NO. 23-141
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AND FILING NOTICE OF COMPLETION FOR THE CALLE REAL WATERLINE IMPROVEMENTS, CIP PROJECT NO. 19516; AND APPROVING A PROJECT CONTINGENCY INCREASE IN THE AMOUNT OF $30,412 WHEREAS, on December 21, 2021, the City Council awarded a construction contract to Diamond Construction & Design for the Calle Real Waterline Improvements, CIP Project No. 19516; and WHEREAS, these improvements consisted of replacing an existing 8-inch water line with a 12-inch water line in advance of the upcoming improvements for the Calle Real Pump Station; and WHEREAS, on July 19, 2022, the City Council approved a construction contingency increase for the Calle Real Waterline Improvements in the amount of $100,000, due to additional excavation and extra depth of the existing 8-inch water line that was being replaced with a new 12-inch water line; and WHEREAS, during construction, two inoperable water valves were requested to be removed by the Water Department by Diamond Construction & Design in the vicinity of the project; and WHEREAS, also during construction, unforeseen and unmarked underground utilities were discovered. An additional rerouting of existing utilities and excavation was performed in order to place a large vault (i.e. 9’x11’) in the ground, within the intersection of Calle Real and Andalucia, to house a potable water pressure reducing station. This work had to be performed immediately without any delays and the cost was $30,412; and WHEREAS, the total project construction costs were $1,234,772; and WHEREAS, the project has now been completed to the satisfaction of the Public Works Director.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the work performed by Diamond Construction & Design for the Calle Real Water Line Improvements, CIP Project No. 19516, is hereby accepted as complete.
SECTION 3. That an increase to the contingency for CIP Project No. 19516 in the amount of $30,412 is hereby approved.
SECTION 4. That the Public Works Director/City Engineer is authorized and directed to execute and record a Notice of Completion for the Calle Real Water Line Improvements, CIP Project No. 19516.
SECTION 5. That the City Clerk is authorized and directed to release the Payment Bond for CIP Project No. 19516 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against Diamond Construction & Design.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
