RESOLUTION NO. 23-155
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AMENDING MASTER TRAFFIC RESOLUTION NO. 1846, ESTABLISHING ‘NO PARKING AREAS’ ON CAMINO CAPISTRANO, VIA BREVE & MONTE VISTA, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, the City has received resident requests for review of pedestrian safety and 5-foot parking prohibitions at walkways within the Baycliff Village Homeowners Association; and WHEREAS, the City has performed a field review and evaluated existing parking conditions on Camino Capistrano, Via Breve and Monte and the City desires to improve pedestrian safety in the area; and WHEREAS, the City of San Clemente Planning Commission (“Planning Commission”), at its regular meeting of November 8, 2023, did not vote to implement the 5-foot of red curb / no-parking zone at the walkways; and WHEREAS, the City Council has considered the information provided by City staff and any information provided by the public at or before the December 5, 2023 City Council meeting, and City Council now wishes to implement the parking prohibitions, which are warranted and are in the public’s best interest.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the above recitals are true and correct.
Section 2. That the project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of minor alteration of existing public structures, facilities or topographical features, involving negligible or no expansion of existing or former use and there is no possibility of a direct or foreseeably indirect effect on the environment.
Section 3. That the Master Traffic Resolution No. 1846, Section 23, entitled “No Parking Areas”, is hereby amended by adding the following subsections:
23.b-2c Breve, Via, east side, 5 feet along the walkway at 101 Via Breve.
23.c-22h Capistrano, Camino, south side, 5 feet along the walkway at 2913 Camino Capistrano.
23.c-22i Capistrano, Camino, south side, 5 feet along the walkway at 2911 Camino Capistrano.
23.c-22j Capistrano, Camino, south side, 5 feet along the walkway at 2905 Camino Capistrano.
23.c-22k Capistrano, Camino, south side, 5 feet along the walkway between 2901 and 2903 Camino Capistrano.
23.m-71 Monte Vista, west side, 5 feet along the walkway between 100 and 112 Monte Vista.
23.m-72 Monte Vista, west side, 5 feet along the walkway between 202 and 212 Monte Vista.
23.m-73 Monte Vista, east side, 5 feet along the walkway between 155 and 159 Monte Vista.
23.m-74 Monte Vista, east side, 5 feet along the walkway between 143 and 153 Monte Vista.
23.m-75 Monte Vista, east side, 5 feet along the walkway between 203 and 239 Monte Vista.
Section 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
