RESOLUTION NO. 24-19
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO HARBOR COATING & RESTORATION FOR THE MONTALVO AND RIVIERA PEDESTRIAN BRIDGES COATING REPLACEMENT PROJECT, CIP PROJECT NO. 23802, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT WHEREAS, on December 3, 2021, Michael Baker International (MBI), Inc., structural engineering consultant, conducted a bridge inspection for both Montalvo and Riviera pedestrian bridges; and WHEREAS, the existing coating on these bridges has reached the end of its service life and will continue to corrode without any corrective action and the proposed treatment and coating will extend the service life of the bridges for several decades; and WHEREAS, based on the MBI’s recommendations as to the scope of work needed, the City conducted formal competitive bidding for the Montalvo and Riviera Pedestrian Bridges Coating Replacement Project, CIP Project No. 23802 (Project) and received six bids in July 27, 2023; and WHEREAS, subsequent to the bid opening on July 27, 2023, further repairs were identified that should be included in the bid package, such as additional corroded steel surfaces below the bridge and some additional plank replacements. Therefore, City staff recommended rejecting all bids, expanding the scope of work, and re-biding the project; and WHEREAS, on October 3, 2023, the City Council approved rejecting all bids received on July 27, 2023; and WHEREAS, the City conducted formal competitive bidding for the Montalvo and Riviera Pedestrian Bridges Coating Replacement, Project No. 23802 (Project), with the expanded scope of work; and WHEREAS, on January 4, 2024, the City received four (4) bids ranging from $458,390 to $875,498 for the Project; and WHEREAS, the lowest responsive and responsible bidder was Harbor Coating & Restoration of Orange, California, in the amount of $539,890, based on the low base bid and the alternate bid item; and WHEREAS, this project was previously determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the state CEQA Guidelines, Class 1 (Existing Facilities, 14 CCR 15301) and a Notice of Exemption was filed with the County of Orange Recorder’s Office on November 08, 2022 for this project. Staff determined that with the expanded scope of work, the project is still categorically exempt under Class 1.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby finds, determines and resolves as follows:

SECTION 1. That the above recitations are true and correct and incorporated herein.

SECTION 2. That the Construction Contract Agreement for the Montalvo and Riviera Pedestrian Bridges Coating Replacement, Project No. 23802, is awarded to Harbor Coating & Restoration.

SECTION 4. That a 15% project contingency of $81,000 for CIP Project No. 23802 is hereby approved. The City Manager is authorized to utilize the project contingency to the extent necessary and proper.

SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
