RESOLUTION NO. 24-20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, OPPOSING ASSEMBLY CONSTITUTIONAL AMENDMENT 13 (VOTING THRESHOLDS) WHEREAS, since the adoption of the California Constitution in 1849, there has never been different thresholds for the approval of constitutional amendments based on the content of the amendment; and WHEREAS, Assembly Constitutional Amendment 13 ("ACA 13") proposes an unprecedented and alarming change in the California Constitution to impose a higher vote threshold ONLY for certain types of amendments to the California Constitution proposed by citizens via a ballot initiative; and WHEREAS, ACA 13 selectively raises the voter approval requirement for those citizen-proposed ballot initiatives making it more difficult for ordinary citizens to pass amendments to the California Constitution that would limit the ability of the State Legislature to increase (impose) taxes upon its already overburdened residents; and WHEREAS, ACA 13 is unfairly lopsided because it places more stringent requirements for amendments to the California Constitution that have the effect of limiting the ability to raise taxes without imposing the same requirements on the legislature, preventing citizens from effectively utilizing the initiative process to limit tax increases; and WHEREAS, in 1978, California voters said "enough!" and wisely adopted Proposition 13 to provide checks and balances on local governments' taxing authority and to ensure a greater representative voice for all Californians who would be taxed; and WHEREAS, the City Council of the City of San Clemente, CA has been historically dedicated to limiting the cost and overreach of government on the taxpayers of San Clemente, as well as protecting San Clemente residents and businesses from onerous fiscal actions by other levels of government which may impair our ability to protect our quality of life and provide for our families; now, therefore be it, NOW, THEREFORE, The City Council of the City of San Clemente does hereby resolve as follows:

Section 1. The City Council of the City of San Clemente, CA stands in firm opposition to ACA13 and any action(s) that would change or weaken the Taxpayer Rights and protections enshrined by the historic, citizen-driven and passed, Proposition 13.

The City Council of the City of San Clemente believes ACA 13 defrauds California taxpayers by cunningly increasing the voter approval requirement for those citizen-proposed ballot initiatives that have the effect of limiting the ability to raise taxes. It is in the very best interests of San Clemente voters to VOTE NO on this proposed power-grab amendment put forth by the California Legislature.

Section 2. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
