RESOLUTION NO. 24-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, RATIFYING AN EMERGENCY CONSTRUCTION CONTRACT WITH DIAMOND CONSTRUCTION & DESIGN FOR BRIDGE DEMOLITION AND REMOVAL FROM METROLINK YARD IN THE AMOUNT OF $60,078; RATIFYING AN EMERGENCY PROFESSIONAL CONSULTANT SERVICES AGREEMENT WITH KPFF CONSULTING ENGINEERS FOR INSPECTION AND STRUCTURAL EVALUATION SERVICES DURING BRIDGE REMOVAL IN THE AMOUNT OF $8,959.10; AND APPROVING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $69,037.10 WHEREAS, on January 15, 2024, the Mariposa Pedestrian Beach Trail Bridge between Mariposa and El Portal beach accesses was closed due to damage to the City’s bridge caused by a coastal bluff failure; and WHEREAS, on January 24, 2024, continued slope movement detached two 86 feet bridge spans from theirs supports, and debris from the slope covered a portion of the railroad tracks shutting down train service; and WHEREAS, OCTA and Metrolink removed the City’s two bridge spans to stabilize the landslide material and return train service; and WHEREAS, the removed bridge spans were relocated to Metrolink’s construction yard and Metrolink requested the City’s removal of the bridge sections from the Metrolink yard as soon as possible due to limited space; and WHEREAS, staff requested informal proposals for removal and disposal of the two bridge spans located at Metrolink’s yard and received two (2) proposals ranging from $57,400 to $62,900 for the Project; and WHEREAS, staff reviewed the proposals and recommended that the City Manager declare an emergency and approve a construction contract with Diamond Construction & Design to provide the removal of the two bridge spans from the yard; and WHEREAS, staff consulted with City’s consultant structural engineer (i.e., KPFF Consulting Engineers), who had been previously been working for the City on the bridge, to provide inspection, structural assessment and participate in meetings with City, OCTA and Metrolink regarding dismantling and demolition of the bridge spans prior to removal; and WHEREAS, KPFF Consulting Engineers submitted an invoice in the amount of $8,959 for the services provided; and WHEREAS, this project was previously determined to be statutorily exempt from the California Environmental Quality Act (CEQA) because it is an “Emergency Project” pursuant to Section 15269 of the state CEQA Guidelines (14 CCR 15269).

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the above recitations are true and correct and incorporated herein.

SECTION 2. That an emergency existed due to the need for immediate disposal of the damaged two bridge spans of the Pedestrian Beach Trail from the Metrolink Yard due to its limited capacity and required immediate action to protect public health and safety, which might not have been possible to maintain if delays attributable to the typical public competitive bidding process had been incurred.

SECTION 3. That the public interest and necessity demanded the immediate expenditure of public funds to safeguard public health.

SECTION 4. That the emergency Construction Contract Agreement for pedestrian bridge demolition and removal from Metrolink’s yard with Diamond Construction & Design in the amount of $60,078 is hereby ratified and approved for execution by the City Manager in a form substantially similar to that presented to the City Council on February 20, 2024.

SECTION 5. That the emergency professional consultant agreement with KPFF Consulting Engineers for inspection and structural evaluation services during the bridge removal in the amount of $8,959.10 is hereby ratified and approved for execution by the City Manager in a form substantially similar to that presented to the City Council on February 20, 2024.

SECTION 6. That a supplemental appropriation in the amount of $69,037.10 from the General Fund into Account No. 014-811-45300-000-11810 is hereby approved.

SECTION 7. That the City Manager, or his designee, is authorized to execute such other documents and take such other and further actions as are necessary and proper to accomplish the purposes of this resolution.

SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

PASSED AND ADOPTED this 20th day of February, 2024.
