RESOLUTION NO. 24-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, SUPPORTING LEGISLATION, ASSEMBLY BILL 2081, RELATING TO ALCOHOL AND DRUG ABUSE TREATMENT FACILITIES WHEREAS, the City of San Clemente recognizes the ever changing landscape of substance abuse treatment, and that having the world’s best climate makes the City of San Clemente and the Orange County Coast a premier destination for those seeking treatment. The popular beaches and outdoor lifestyle are key to promotion of a healthy life, and are sought after by those in treatment.
WHEREAS, the City of San Clemente has lost the ability to control placement and operation of substance abuse treatment facilities/homes, which has resulted in some no longer being aligned with the values of the City.
WHEREAS, Assembly Bill 2081 by Assemblywoman Laurie Davies would require all substance abuse treatment facilities to post on their internet website anytime they have been found to have violated state laws or regulations. AB 2081 will fine in the amount of $2,500 any treatment facility/home that does not post violations within 14 business days. AB 2081 allows patients and their families the transparency that they deserve when seeking healthcare treatment.
WHEREAS, Assembly Bill 2081 intends to prevent the abuse of patients by substance abuse treatment facilities and their owners. AB 2081, by making public the violations of treatment facilities, allows the City to more accurately keep track of substance abuse facilities and their impact on the community.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1. The City Council approves to officially support Assembly Bill 2081 which would require violations of state laws or regulations to be posted to the alcohol and/or drug abuse treatment facility’s internet website within 14 business days or incur a fine.
Section 2. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
