RESOLUTION NO. 24-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING THE 2024-2025 ANNUAL ACTION PLAN AND AUTHORIZING SUBMISSION OF THE PLAN TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT WHEREAS, the City of San Clemente is eligible to participate in the Community Development Block Grant ("CDBG") Program; and WHEREAS, to receive CDBG funds, the City is required to prepare a five-year Consolidated Plan for Fiscal Years 2020-2021 through 2024-2025, which the City Council approved on May 19, 2020; and WHEREAS, the Annual Action Plan, a component of the Consolidated Plan, is updated each fiscal year and includes the application to the U.S. Department of Housing and Urban Development ("HUD") for CDBG funds and required certifications related to the receipt and use of CDBG funds; and WHEREAS, the actual use of CDBG funds for specific projects and programs may require the execution of additional forms and certifications by a duly authorized representative of the City; and WHEREAS, HUD has not yet indicated the actual amount of funds available for the City so the City has had to make a reasonable estimation thereof.
NOW THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. The City Council hereby approves the 2024-2025 Annual Action Plan, a copy of which is attached to the agenda report dated April 16, 2024, entitled “Adoption of the Draft 2024-2025 Annual Action Plan for Expenditures of Community Development Block Grant Funds,” and is incorporated herein fully by this reference.
SECTION 2. The City Manager, or the City Manager's designee, is authorized to submit the 2024-2025 Annual Action Plan to HUD on behalf of the City.
SECTION 3. The City Manager, or the City Manager's designee, is hereby authorized and directed to approve and execute any and all HUD- and/or CDBG-related applications, certifications, agreements, and/or other documents or instruments and take such actions as are necessary and proper to implement the approvals and authorizations as set forth herein, including but not limited to proportionally increasing or decreasing the estimated CDBG allocations for approved activities identified in the 2024-2025 Annual Action Plan to match the City's actual 2024-2025 CDBG allocation once determined, approved, and announced by HUD.
SECTION 4. The City Manager, or the City Manager's designee, is hereby authorized to accept the final HUD-allocated grant revenues, estimated at $434,471, from to account #017-000-33712, and the actual amounts of the same so granted.
SECTION 5. The City Manager, or the City Manager's designee, is hereby authorized to allot a related budget appropriation of the final HUD-allocated grant revenues, estimated at $434,471, to the CDBG fund for the amounts in the 2024-2025 Annual Action Plan.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
