RESOLUTION NO. 24-80
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A PROFESSIONAL SERVICES AGREEMENT TO MICHAEL BAKER INTERNATIONAL FOR THE UPDATE OF THE CITY’S LOCAL HAZARD MITIGATION PLAN (LHMP), AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT IN AN AMOUNT NOT TO EXCEED $98,750 AND APPROVING A RELATED APPROPRIATION IN THAT AMOUNT WHEREAS, the City maintains a Natural Hazard Mitigation Plan, last dated September 3, 2004. The 2004 plan was locally adopted on January 18, 2005, through City Council Resolution #05-06. The plan was FEMA approved as evidenced by a FEMA Region IX Approval Letter dated February 14, 2005; and WHEREAS, the Federal Disaster Mitigation Act of 2000, P.L. 106-390, 44 CFR Section 201.6, requires a Local Hazard Mitigation Plan (LHMP) to be updated and FEMA approved every five years. There are no records that the 2004 plan was updated and FEMA approved as required by P.L. 106-390, 44 CFR Section 201.6; and WHEREAS, in order for the City of San Clemente to be eligible to receive certain FEMA hazard-mitigation grant funds, the City is required to have an LHMP approved by the California Governor’s Office of Emergency Services (CalOES) and FEMA within the last 5 years; and WHEREAS, an updated LHMP will enhance the City’s ability to proactively acknowledge and locate hazards efficiently, thereby improving the City’s overall preparedness and resilience; and WHEREAS, this type of emergency planning document requires a significant amount of specialized subject-matter expertise, as this effort will involve comprehensive research and analysis to align the City’s LHMP with FEMA's most recent Local Multi-Hazard Mitigation Planning Guidance, which became effective on April 19, 2023; and WHEREAS, pursuant to City Policy 201-2-3, in March and April 2024, City staff conducted a Request for Proposals (RFP) to facilitate the selection of a professional services contractor to carry out the update of the LHMP; and WHEREAS, after careful consideration of the proposals submitted in response to the City’s RFP, City staff found the Michael Baker International (MBI) proposal to be of the highest quality, and determined that their proposal was the most advantageous to the City for this particular project. City staff’s recommendation is based on the combination of various factors including experience of the firm, understanding of the project, proposed timeline of the project, and cost, which was fair and reasonable; and WHEREAS, MBI’s proposal outlines a streamlined schedule capable of delivering a draft LHMP as soon as five months, facilitating earlier eligibility for FEMA hazard mitigation grant resources once the document is approved by the California Governor’s Office of Emergency Services (CalOES) and FEMA; and WHEREAS, the City Council considered the professional services agreement with MBI for the update of the City’s Local Hazard Mitigation Plan (LHMP) at a duly noticed public City Council meeting on June 4, 2024.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
