A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE CITY TO ENTER INTO A REGIONAL CONTRACT BETWEEN THE SOUTH ORANGE COUNTY WASTEWATER AUTHORITY (SOCWA), POLYDYNE, INC., AND SOCWA ENTITIES FOR SUPPLY OF POLYMER TO THE WATER RECLAMATION PLANT FOR WASTEWATER TREATMENT, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT, AUTHORIZING THE PUBLIC WORKS DIRECTOR TO APPROVE UP TO FOUR ONE-YEAR RENEWALS, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the City of San Clemente provides maintenance and operation of the City’s sanitary sewer collection and treatment system infrastructure in order to ensure wastewater service to protect public health and safety, in compliance with all local, state and federal regulatory requirements; and WHEREAS, the City of San Clemente Water Reclamation Plant treats wastewater through a series of physical, biological, and chemical treatment processes to meet regulatory requirements; and WHEREAS, Polymer is a chemical that is necessary for wastewater treatment for separating water from solids during solids processing in the wastewater treatment process; and WHEREAS, in the past, the City of San Clemente has partnered with SOCWA and other agencies that are collectively referred to as SOCWA entities in the joint contract (specifically, Santa Margarita Water District and Moulton Niguel Water District) to purchase wastewater treatment chemicals; and WHEREAS, SOCWA staff initiated a Request for Quotes process to solicit new potential vendors to provide Polymer for SOCWA and its Member Agencies and Polydyne, Inc. provided the lowest quote; and WHEREAS, SOCWA will enter into an initial one-year contract with Polydyne, Inc. for Polymer, with four optional one-year renewals that will be negotiated at the expiration of each term; and WHEREAS, the City of San Clemente and the other SOCWA entities can join the regional contract for the supply of Polymer; and WHEREAS, joining the regional contract with SOCWA, Polydyne, Inc., and SOCWA entities is in the best interests of the City and the public.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the above recitals are true and correct and incorporated herein as findings.
Section 2. That this project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, and there is no reasonable possibility that the activity will have a significant direct or foreseeable indirect effect on the environment.
This project is also categorically exempt from CEQA under Class 7 (Actions by Regulatory Agencies for Protection of Natural Resources, 14 CCR section 15307) of the State CEQA Guidelines because it consists of actions taken by regulatory agencies as authorized by state law or local ordinance to assure the maintenance, restoration, or enhancement of a natural resource, specifically water, where the regulatory process involves procedures for protection of the environment.
Section 3. That approval is hereby granted for the City to enter into the regional contract with SOCWA, Polydyne, Inc., and SOCWA entities for a one-year term beginning June 1, 2024, for the delivery and supply of Polymer to the City’s Water Reclamation Plant (WRP) in an amount not to exceed $230,000. The City Manager is authorized and directed to execute that contract in a form substantially similar to that presented to the City Council on May 21, 2024. The Public Works Director is authorized to approve up to four one-year renewals to such contract for amounts not to exceed the approved budget amounts for Polymer in each appropriate fiscal year.
Section 4. That staff is authorized and directed to take such other and further actions and execute such other and further documents as may be necessary to accomplish the purposes of this resolution.
Section 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
