RESOLUTION NO. 24-101
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A FIVE-YEAR LEASE AGREEMENT FOR THE CITY OWNED BUILDING AT 1100 N. EL CAMINO REAL (APN 692-393-01) WITH TRESTLES PROPERTY MANAGEMENT LLC WHEREAS, pursuant to City Policy 901-1, the City delegates the authority to engage in negotiations with prospective tenants for City-owned property to the City Manager; and WHEREAS, the subject property at 1100 N. El Camino Real, APN 692-393-01; owned by the City, is currently vacant and is available for a prospective tenant and multi-year lease; and WHEREAS, in March, 2024, the City extended an exclusive listing agreement to Josh Cunningham, Kidder Mathews, a commercial real estate firm, for consultant real estate listing services of City-owned building at 1100 N. El Camino Real; and WHEREAS, the City’s consultant facilitated the listing of the subject property and obtained two offers for lease. City staff reviewed the offers presented and determined the offer submitted by Trestles Property Management for a five-year term was the most beneficial to the City, and allowed for occupancy of the building at the soonest opportunity possible.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. The above recitals are true and correct and incorporated herein by reference.
Section 2. The Standard Industrial/Commercial Single-Tenant Lease - Gross, included as Attachment 2 to the agenda report, dated June 18, 2024, entitled “Consideration of a Resolution to Approve a Five-Year Lease for the City Owned Commercial Building Located at 1100 N. EL Camino Real (APN 692-393-01),” is hereby approved, and; Section 3. The City Manager, or the City Manager's designee, is authorized and directed to execute the Standard Industrial/Commercial Single-Tenant Lease - Gross with Trestles Property Management, LLC, for a base rent of $3,724 per month after the first 3 months, with 3% increases annually, and including the commission for consultant real estate services not to exceed 6% of the gross lease and one three-year option to renew at market rental rate, in a form substantially similar to that presented to the City Council on June 18, 2024, and; Section 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
