RESOLUTION NO. 24-102
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A PROFESSIONAL SERVICES AGREEMENT TO WYNNE CRE, INC. FOR COMMERCIAL REAL ESTATE CONSULTING SERVICES FOR THE LEASE OF 1030 CALLE NEGOCIO (APN – 688-142-35) AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WHEREAS, pursuant to City Policy 201-2-3, the City delegates the authority to engage with prospective commercial real estate consultant firms following a competitive bid process to the City Manager, or their designee; and WHEREAS, the subject property at 1030 Calle Negocio, APN 688-142-35, legally described as N TR 12766 BLK LOT 10, owned by the City, is currently vacant and is available for a prospective tenant and multi-year lease; and WHEREAS, in April, 2024, the City initiated a Request for Proposals from local commercial real estate firms for the leasing of City-owned property at 1030 Calle Negocio, and obtained three proposals for such; and WHEREAS, the City reviewed the proposals and interviewed firms based on their proposed services and the City’s specific needs for the successful completion of this work and services; and WHEREAS, City staff determined that the proposal submitted by Wynne CRE, INC. was the most advantageous to the City for this particular lease of property at 1030 Calle Negocio, as this decision was based on the combination of various factors including experience of the firm, demonstration of the quality of the services provided, understanding of the project, proposed timeline of the project, and the cost, which is fair and reasonable.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. The above recitals are true and correct and incorporated herein by reference.
Section 2. A Professional Services Agreement for professional commercial real estate consulting services is hereby awarded to Wynne CRE, Inc. for the lease of 1030 Calle Negocio (APN – 688-142-35); and Section 3. The City Manager, or the City Manager's designee, is authorized and directed to execute the Professional Services Agreement with Wynne CRE, INC. for a fee in the form of commission not to exceed 6% of total rent for the length of the term, in a form substantially similar to that presented to the City Council on June 18, 2024, and; Section 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
