RESOLUTION NO. 24-121
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE MAYOR TO EXECUTE A LETTER IN OPPOSITION TO ASSEMBLY BILL 2560 (ALVAREZ) AND CAUSE THE DELIVERY OF SAID LETTER TO THE CHAIR OF THE CALIFORNIA STATE ASSEMBLY’S LOCAL GOVERNMENT COMMITTEE WHEREAS, Assembly Bill (AB) 2560, as proposed, is inconsistent with the long- standing provisions of the California Coastal Act and the land use regulations of the City of San Clemente; and WHEREAS, AB 2560, as proposed, will transfer local housing authority to the California Coastal Commission by requiring each Local Coastal Program to include provisions for housing, density bonuses and other provisions that must be approved by the California Coastal Commission; and WHEREAS, AB 2560, as proposed, will transfer further local housing authority to the California Department of Housing and Community Development by requiring each City to make accommodations for housing in coastal areas in future General Plan Housing Elements; and WHEREAS, AB 2560, because of the inconsistencies between housing programs and the provisions of the California Coastal Act promoting visitor accommodations, activities, and coastal access, the Coastal Commission was relieved of its housing authority within the first five years of the Coastal Act being codified in 1976; and WHEREAS, AB 2560, as proposed, will prevent cities from achieving housing goals by having dueling direction from two state agencies for how to plan and develop housing along the coast; and WHEREAS, AB 2560, as proposed, requires all coastal cities to update their Local Coastal Programs – an unfunded state mandate costing millions of dollars – in a truncated year and a half when most programs take many years to develop.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Clemente that:

Section 1. The City Council of the City of San Clemente opposes AB 2560 based on the findings of the recitals above and on the following grounds:

It applies a one size fits all approach to the complexities of the California coastline with decisions being removed from local elected officials who know the needs of their communities far better than State agencies.

It would hinder the City’s ability to implement the provisions of the California Coastal Act to provide access to all, and visitor accommodations and amenities.

Section 2. The City Council authorizes the Mayor to execute and cause the delivery a the letter in opposition to AB 2560 in a form substantially similar to that presented to the City Council on August 6, 2024.

Section 3. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
