RESOLUTION NO. 24-130
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A STANDARD INDUSTRIAL/COMMERCIAL SINGLE-TENANT LEASE - GROSS FOR A FIVE-YEAR LEASE AGREEMENT, WITH TWO THREE-YEAR OPTIONS, FOR THE CITY OWNED BUILDING AT 1030 CALLE NEGOCIO (APN 688-142-35) BY AND BETWEEN CITY AND XLR8 EMS, LLC AND APPROVING A SUPPLEMENTAL APPROPRIATION FOR BROKER COMMISSIONS WHEREAS, pursuant to City Policy 901-1, the City delegates the authority to engage in negotiations with prospective tenants for City-owned property to the City Manager; and WHEREAS, the subject property at 1030 Calle Negocio, APN 688-142-35, is owned by the City, is currently vacant and is available for a prospective tenant and multi-year lease; and WHEREAS, in June, 2024, the City awarded a Professional Services Agreement to James Wynne, WynneCRE, Inc., (“Broker”) a commercial real estate firm, for consultant real estate listing services to lease the City-owned building at 1030 Calle Negocio; and WHEREAS, the City’s Broker facilitated the listing of the subject property and obtained several inquiries and one offer for lease; and WHEREAS, City staff reviewed the offer presented and determined the offer submitted by XLR8 EMS, LLC, a California Limited Liability Company, a local business headquartered at 1020 Calle Negocio, for a five-year term, with two three-year options to renew, was beneficial to the City, and allows for occupancy of the building at the soonest opportunity possible.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. The above recitals are true and correct and incorporated herein by reference.
Section 2. The Standard Industrial/Commercial Single-Tenant Lease – Gross for the lease of 1030 Calle Negocio to XLR8 EMS, LLC is approved in a form substantially similar to that presented to the City Council on August 20, 2024.
Section 3. The City Manager, or the City Manager's designee, is authorized and directed to execute the Standard Industrial/Commercial Single-Tenant Lease - Gross in a form substantially similar to that presented to the City Council on August 20, 2024.
Section 4. The City Manager, or the City Manager's designee, is authorized and directed to accept revenues in the amount of $112,567 for FY 2025 in account # 001-000-36253 - Negocio Lease Revenues.
Section 5. A supplemental appropriation in the amount of $61,470 to account #001-151-43605 - Broker Commissions, is approved.
Section 6. City staff is authorized and directed to take such additional actions and execute such additional documents as may be necessary and proper to accomplish the purposes of this resolution.
Section 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
