RESOLUTION NO. 24-132
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A PROFESSIONAL SERVICES AGREEMENT TO CABCO YELLOW, INC. FOR SENIOR MOBILITY PROGRAM TRANSPORTATION SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR 15301) WHEREAS, the City wishes to continue providing senior transportation services to help fill the gap between local fixed-route buses and ADA paratransit; and WHEREAS, the professional on-demand transportation services under contract with Cabco Yellow, Inc. expired on August 18, 2024; and WHEREAS, the City of San Clemente released a Request For Proposals for Senior Mobility Program Transportation Services and Cabco Yellow, Inc. was the only proposer; and WHEREAS, Cabco Yellow, Inc. is qualified to perform the services and its prices are fair and reasonable.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the above recitations are true and correct and incorporated herein fully.

SECTION 2. That based on a review of substantial evidence in the record as a whole, this project is determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 of the state CEQA Guidelines section 15301 (Existing Facilities, 14 CCR 15301) because it continues an existing program and consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, and there is no possibility of a direct or foreseeable indirect substantial impact on the environment.

SECTION 3. That a Professional Services Agreement is awarded to Cabco Yellow, Inc. for Senior Mobility Program Transportation Services.

SECTION 4. That the City Manager is authorized to execute a three-year contract with Cabco Yellow, Inc. in a form substantially similar to that present to City Council on August 20, 2024, in an amount not to exceed $300,000, with two optional one-year extensions not to exceed $100,000 per year, exercisable in the City Manager’s discretion.

SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
