RESOLUTION NO. 24-135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING RESPONSE TO FINDINGS AND RECOMMENDATIONS IN THE REPORT OF THE ORANGE COUNTY GRAND JURY – “EMERGING OPPORTUNITIES IN SOUTH COUNTY WATER/WASTEWATER SYSTEMS” WHEREAS, on June 21, 2024, the 2023-2024 Orange County Grand Jury report, “Emerging Opportunities in South County Water/Wastewater Systems” was published; and WHEREAS, the report focused on the 2021 consolidation of the City of San Juan Capistrano’s water and wastewater utilities with Santa Margarita Water District and how rate structure changes affected rate payers (lessons learned for future consolidations), and challenges associated with differing interests amongst South Orange County Wastewater Authority’s member agencies related to the future operation of the agency as agreement begin to expire; and WHEREAS, California Penal Code Section 933 requires the City to provide a response to each of the findings and recommendations in the report; and WHEREAS, California Penal Code Section 933.05 specifies the manner in which the responses and comments on the findings and recommendations are to be made; and WHEREAS, the City values the opportunity to respond to the report, share our perspective, and provide firsthand knowledge to each of the issues requested by the Grand Jury; and WHEREAS, the responses must be submitted to the Presiding Judge of the Superior Court by September 19, 2024; and WHEREAS, the City Council has reviewed the report.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the Mayor is authorized and directed to respond to the findings and recommendations noted in the report by submitting a letter to the Presiding Judge of the Superior Court by September 19, 2024 in substantially the same form as attached to this Resolution as Exhibit A, which is incorporated fully herein by this reference, and that such responses are approved.
SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
