RESOLUTION NO. 24-153
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING FIRST AMENDMENTS TO TWO SEPARATE PROFESSIONAL SERVICES AGREEMENTS WITH CIVICA LAW GROUP, APC FOR (1) MUNICIPAL CITATION LEGAL SERVICES AND (2) CODE ENFORCEMENT LEGAL SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENTS; AND APPROPRIATING $44,400 WHEREAS, on March 7, 2023, the City Council approved two contracts with Civica Law Group, APC, one for Municipal Citation Legal Services and one for Code Enforcement Legal services; and WHEREAS, rising costs associated with increased fees for attorney’s time, case management, and the growing complexity of individual cases, are resulting in lengthier court proceedings require more legal counsel time than previously contemplated for the two contracts; and WHEREAS, an additional appropriation of funds is appropriate to address these increased service costs for the Municipal Citation Legal Services contract, and raising the total not-to-exceed amount of this flat-rate contract; and WHEREAS, the Code Enforcement Legal Services contract’s rate schedule has remained unchanged under the current, and previous contract for such services, for the past five years, and requires an update to reflect the current costs of providing these legal services.
NOW THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. The above recitals are true and correct and incorporated herein fully by reference.
SECTION 2. The first amendment to Contract C23-10 for Code Enforcement Legal Services with Civica Law Group, APC to update the fee rate schedule is approved.
SECTION 3. The City Manager, or the City Manager's designee, is hereby authorized and directed to execute a first amendment to Contract C23-10 for Code Enforcement Legal Services with Civica Law Group, APC in amount not to exceed $186,000 annually and in a form substantially similar to that presented to the City Council on October 1, 2024.
SECTION 4. The first amendment to Contract C23-11 for Municipal Citation Legal Services with Civica Law Group, APC to increase the flat rate fee, in an amount not to exceed $144,000 annually is approved.
SECTION 5. The City Manager, or the City Manager's designee, is hereby authorized and directed to execute the first amendment to Contract C23-11 for Municipal Citation Legal Services with Civica Law Group, APC in a form substantially similar to that presented to the City Council on October 1, 2024.
SECTION 6. A budget appropriation, not to exceed $44,400.00, to General Fund Account Number 001-218-43640-000-00000 for Fiscal Years 2024-25 and 2025-26 is approved.
SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
