A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AN AGREEMENT WITH THE METROPOLITAN WATER DISTRICT OF ORANGE COUNTY (MWDOC) AND HERNDON SOLUTIONS GROUP (HSG) FOR SHARING CONSULTANT COSTS FOR COMPLETION OF THE FEDERALLY MANDATED AMERICAN WATER INFRASTRUCTURE ACT OF 2018 (AWIA) PROJECT UPDATES, INCLUDING THE RISK AND RESILIENCY ASSESSMENT (RRA) AND THE EMERGENCY RESPONSE PLAN (ERP), AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AND COMMITMENT LETTER AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 9 (INSPECTIONS, 14 CCR 15309) WHEREAS, the American Water Infrastructure Act of 2018 mandates an update to the Risk and Resiliency Assessment and Emergency Response Plan every five years; and WHEREAS, the Municipal Water District of Orange County (MWDOC) issued an request for proposal for a shared services contract to assist member agencies, including the City of San Clemente, in completing the required updates and selected Herndon Solutions Group to accomplish the task; and WHEREAS, MWDOC awarded Herndon Solutions Group the Shared Services Agreement to assist member agencies to meet the US EPA regulations, and the City of San Clemente requires assistance to meet the US EPA regulations; and WHEREAS, the anticipated costs of the City of San Clemente’s participation in the cost sharing agreement with MWDOC and Herndon Solutions Group will be for an amount not to exceed $66,700, and will enable the City to fulfill its requirements under the US EPA regulations and is in the best interests of the City and the public.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the above recitals are true and correct and incorporated herein fully as findings.
Section 2. That based on substantial evidence in the record as a whole, this project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 9 (Inspections, 14 CCR 15309), Section 15309 of the state CEQA Guidelines because it consists of activities limited entirely to inspections, to check for performance of an operation, or quality, health, or safety of a project, including related activities such as inspection for possible mislabeling, misrepresentation, or adulteration of products and there is no possibility of direct or foreseeable indirect substantial impacts on the environment.
Section 3. That the Agreement For Sharing Consultant Costs For Completion Of Orange County Water And Wastewater Multi-Jurisdictional Hazard Mitigation Plan And America Water Infrastructure Act Of 2018 Projects (the “Agreement”) and the Participating Agency Terms And Conditions (“Commitment Letter”) are hereby approved.
Section 4. That the City Manager is authorized and directed to execute the Agreement and the Commitment Letter in forms substantially similar to those presented to the City Council on October 1, 2024 for an amount not to exceed $66,700.
Section 5. That the City Manager is authorized and directed to execute such other documents and take such other and further actions as are necessary and proper to accomplish the purposes of this resolution and comply with federal requirements related thereto.
Section 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
