FIRST AMENDMENT TO
PROFESSIONAL CONSULTANT SERVICES AGREEMENT
This First Amendment to the Professional Consultant Services Agreement (the “First Amendment”) is made and entered into on this 19 of November, 2024, by and between the City of San Clemente, California municipal corporation (“City”), and West Coast Code Consultants, Inc. (“Consultant”), a California corporation. City and Consultant are sometimes individually referred to herein as “Party” and collectively as “Parties”.
RECITALS
Whereas, following a request for proposals process, on January 16, 2024, after City Council approval and award, the City entered into a Professional Services Consultant Agreement with West Coast Code Consultants, Inc. (the “Agreement”) to perform and assure responsibility of certain professional building plan review consulting services; and Whereas, an increase in plan submission has resulted in additional use of the City’s plan review consultants to maintain public service levels with timely turnaround for each technical review; and Whereas, the Parties hereto desire to enter this First Amendment to amend the Agreement on the terms and conditions stated herein.
NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby confirmed, the Parties hereto agree as follows:
COVENANTS
SECTION 1: Section 3.3.1 (Compensation) of the Agreement is hereby amended to state that the total compensation shall not exceed One Hundred Fifty Thousand Dollars ($150,000) per year.
SECTION 2: Except as expressly amended by this First Amendment, the Agreement and all its provisions shall remain in full force and effect. [SIGNATURES ON FOLLOWING PAGE]
