RESOLUTION NO. 24-188
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AND FILING NOTICE OF COMPLETION FOR THE SAN CLEMENTE VILLAS BY THE SEA STORM DRAIN REPAIR, PROJECT NO. 26001 WHEREAS, On September 5, 2023, the City Council awarded a construction contract to GCI Construction, Inc. for the San Clemente Villas by the Sea Storm Drain Repair, Project No. 26001; and WHEREAS, on May 22, 2023, City staff were informed by the San Clemente Villas by the Sea about a sinkhole at the southwest corner of the property over an underground 30-inch storm drain; and WHEREAS, this necessitated an emergency repair to remove and replace this section of pipe in advance of the coming rainy season to prevent potential slope failure; and WHEREAS, on June 16, 2023, staff contacted GCI Construction, Inc., a local contractor, to immediately start the repair work, which has been completed to the City Engineer’s satisfaction (except for the scope of work that was removed from the contract pursuant to an agreement between the parties).
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the San Clemente Villas by the Sea Storm Drain Repair, Project No. 26001, is hereby accepted from GCI Construction, Inc.
SECTION 3. That the Public Works Director/City Engineer is authorized and directed to execute and record the Notice of Completion for the San Clemente Villas by the Sea Storm Drain Repair, Project No. 26001.
SECTION 4. That the City Clerk is authorized and directed to release the Payment Bond 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, GCI Construction, Inc.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
