Section 1. That the above recitations are true and correct and incorporated herein.

Section 2. That the City Council determines that the construction of an asphalt pump track is consistent with the Richard T. Steed Memorial Park Master Plan and is consistent with the environmental findings established in the IS/MND previously certified by the City Council.

Section 3. That the City Council finds that piggybacking on the competitively awarded agreement of the City of Moreno Valley will obtain the same supplies, equipment or services at the same or lower prices that utilized competitive bidding procedures and accomplishes the purpose and intent of competitive bidding requirements under City Policy and therefore authorizes an exemption to the formal solicitation process allowing for the contract award to be granted to American Ramp Company under Policy 201-2-1 Section XI A.1.4 and 1.4.3(b).

Section 4. That a piggy-back contract is hereby awarded to American Ramp Company, Inc., the lowest responsible bidder in the City of Moreno Valley’s competitive formal bidding process, for the construction of the pump track at Richard T. Steed Memorial Park, in an amount not to exceed $605,500.

Section 5. That the City Manager is authorized to execute a Public Works Contract with American Ramp Company, Inc. providing for the design and construction of the pump track at Richard T. Steed Memorial Park, in an amount not to exceed $605,500, in a form substantial similar to that awarded by the City of Moreno Valley with such project specific changes as may be necessary in the City Manager’s judgment and consistent with City Policy and Public Contracting Law in consultation with the City Attorney.

Section 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
