RESOLUTION NO. 24-199
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AND FILING NOTICE OF COMPLETION FOR THE NORTH BEACH EMERGENCY SAND PLACEMENT PROJECT, PROJECT NO. 14901 WHEREAS, on June 18, 2024, the City Council awarded a construction contract to GCI Construction, Inc. to deliver and spread 30,000 cubic yards of sand from the Santa Ana River on the North Beach area, along approximately 1,500 feet of the shoreline.
WHEREAS, the City had been experiencing critical erosion hot spots that had developed at North Beach in the past years; and WHEREAS, the City Council declared the project as an emergency; and WHEREAS, on September 17, 2024, the City Council approved an increase to the project contingency from the original 10% to 19% to allow placement of additional 7,000 cubic yards of sand; and WHEREAS, the total sand placed at the North Beach was 37,000 cubic yards.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. Accept the North Beach Emergency Sand Placement Project, Project No. 14901, from GCI Construction, Inc.
SECTION 3. The Public Works Director/City Engineer is authorized and directed to execute and record the Notice of Completion for the North Beach Emergency Sand Placement Project, Project No. 14901.
SECTION 4. The City Clerk is authorized and directed to release the Payment Bond 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, GCI Construction, Inc.
SECTION 5. The City Clerk is authorized and directed to release the Performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director in the amount of 25% of the total construction cost.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
