RESOLUTION NO. 24-197
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING, RECEIVING AND FILING THE CITY OF SAN CLEMENTE’S ANNUAL AND FIVE-YEAR REPORTS CONCERNING THE MITIGATION FEE ACT WHEREAS, the State Law under Government Code Section 66001 and 66006 require local agencies that require the payment of development fees to submit annual and five-year notices detailing the status of those fees; and WHEREAS, an annual report concerning the Mitigation Fee Act for the fiscal year ended June 30, 2024 has been prepared and posted in accordance with State law and is attached to this resolution as Exhibit A; and WHEREAS, the five-year report concerning the Mitigation Fee Act for the period July 1, 2019 through June 30, 2024 has been prepared and posted in accordance with State law and is attached to this resolution as Exhibit B; and WHEREAS, the annual and five-year report have been made available to the public at least fifteen (15) days prior to the City Council meeting; and WHEREAS, on December 10, 2024, in accordance with State law, the City Council held a duly noticed public hearing concerning the City of San Clemente’s Mitigation Fee Act requirement for the annual report ending June 30, 2024 and the five-year report ending June 30, 2024; and WHEREAS, the annual and five-year report have been filed with the governing body.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the above recitals are true and correct and incorporated herein as findings.
Section 2. That the reports attached to this resolution as Exhibit A and B are hereby approved, received and filed.
Section 3. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
