RESOLUTION NO. 25-09
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO ROBERTSON INDUSTRIES, INC. FOR THE SAN GORGONIO PARK PLAYGROUND SUBSTRATE SURFACE REPLACEMENT, CIP PROJECT NO. 11148; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION CONTRACT IN AN AMOUNT NOT TO EXCEED $144,595; APPROVING A 10% PROJECT CONTINGENCY; ACCEPTING A $20,000 DONATION FROM THE FRIENDS OF SAN CLEMENTE BEACHES, PARKS & RECREATION FOUNDATION, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 2 (REPLACEMENT OR RECONSTRUCTION, 14 CCR SECTION 15320) OF THE STATE CEQA GUIDELINES WHEREAS, the existing engineered wood fiber playground substrate surface at San Gorgonio Park has been approved by the City Council for replacement with a rubberized surface material; and WHEREAS, the City issued a formal Request for Proposal (RFP) the San Gorgonio Park Playground Substrate Surface Replacement, CIP Project No. 11148 (Project) in October 2024 for the removal and replacement of the playground substrate surface, and bids were solicited from qualified contractors; and WHEREAS, Robertson Industries, Inc. submitted the lowest responsive and responsible bid in the amount of $144,595; and WHEREAS, staff has determined that no local vendors are qualified to perform the specialized work required for this Project; and WHEREAS, the Project scope includes the removal of the existing surface and installation of a new playground substrate surface that meets all applicable safety and accessibility standards; and WHEREAS, the Friends of San Clemente Beaches, Parks & Recreation Foundation has offered a donation of $20,000 to help fund the Project.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
Section 1. That the above recitations are true and correct and incorporated fully herein.
Section 2. Based on a review of the record as a whole, this Project is hereby determined to be categorically exempt from the California Environmental Quality Act (“CEQA”) under Section 15302, Class 2 (Replacement of Reconstruction of Existing Facilities, 14 CCR 15302) of the state CEQA Guidelines because it consists of replacement of existing playground substrate/structure where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced with no significant direct or foreseeable indirect environmental impact.
Section 3. The construction contract for the removal and replacement of the San Gorgonio Park playground substrate surfacing is hereby awarded to Robertson Industries, Inc. as the lowest responsive and responsible bidder.
Section 4. The City Manager is authorized and directed to execute a construction contract with Robertson Industries, Inc. for the removal and replacement of the San Gorgonio Park playground substrate surfacing in an amount not to exceed $144,595 and in a form substantially similar to that presented to the City Council on January 14, 2025.
Section 5. A 10% construction contingency of $14,495 for the Project is hereby approved. The City Manager is authorized to utilize the Project contingency to the extent necessary and proper.
Section 6. With gratitude, the City hereby accepts a donation of $20,000 from the Friends of San Clemente Beaches, Parks & Recreation Foundation for the Project. The Beaches, Parks & Recreation Director is authorized and directed to work with the Friends Foundation on appropriate signage acknowledging the donation.
Section 7. City staff is authorized and directed to execute such other documents and take such other and further actions as may be necessary and proper to accomplish the purposes of this resolution.
Section 8. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
