RESOLUTION NO. 25-14
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF NOTICES OF COMPLETION FOR THE RICHARD T. STEED MEMORIAL PARK AND SAN GORGONIO PARK EQUIPMENT REPLACEMENTS (CIP NOS. 11148 AND 12107) WHEREAS, on September 20, 2022, the City Council awarded a construction contract to Kompan California, Inc. for the Steed Memorial Park Playground Equipment Replacement, CIP No. 12107, and San Gorgonio Park Playground Equipment Replacement, CIP No. 11148; and WHEREAS, the work consisted of the replacement of all playground equipment and substrate surfacing at both sites; and WHEREAS, the Project Manager has duly certified to the construction and completion of the projects in a manner satisfactory for the City of San Clemente.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
Section 1. The Richard T. Steed Memorial Park (CIP No. 12107) and San Gorgonio Park Playground (CIP No. 11148) Equipment Replacements have been completed and are hereby accepted from Kompan California, Inc.
Section 2. The Public Works Director/City Engineer of the City of San Clemente is hereby authorized and directed to execute and file Notices of Completion for the acceptance of said projects.
Section 3. The City Clerk is authorized and directed to release the payment bond 35 days from the recordation of the respective Notices of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, Kompan California, Inc.
Section 4. The City Clerk to release the performance bond for these projects upon receipt of a warranty bond or bonds in a form acceptable to the Public Works Director in the amount of 25% of the total construction cost.
Section 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
