RESOLUTION NO. 25-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING FIVE-YEAR PROFESSIONAL SERVICE AGREEMENTS TO HINDERLITER, DE LLAMAS & ASSOCIATES AND HDL COREN AND CONE FOR TAX AND FEE CONSULTING SERVICES, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS AND APPROVING A 19% PROJECT CONTINGENCY WHEREAS, the City routinely engages professional consultants with expertise in tax and fee revenue management services; and WHEREAS, in 2024, the City conducted a formal request for proposal for property tax, sales and use tax, business tax, and transient occupancy tax consulting services (Tax and Fee Consulting Services); and WHEREAS, on July 16, 2024, City staff publicly advertised the Tax and Fee Consulting Services Request for Proposals on the City’s electronic bidding system Planet Bids; and WHEREAS, four proposals were received, offering services for project categories individually and collectively, with 5-year cost of services projected in the amounts of $1,178,510, $782,500, $421,500 and $105,000 for the desired project objectives; and WHEREAS, City staff reviewed the proposals, conducted interviews with all four prospective bidders and rated them according to the weighted criteria listed in the Request for Proposals and determined that Hinderliter, de Llamas and Associates and HdL Coren & Cone are qualified to perform the services, have fair and reasonable fees, and ranked the highest with the most competitive all-inclusive service and pricing options that aligned with project objectives.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolves as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
Section 2. That a five-year Professional Services Agreement is hereby awarded to Hinderliter, de Llamas & Associates for Sales and Use Tax, Transient Occupancy Tax Services, Business License and Transient Occupancy Tax Software Services.
Section 3. That the City Manager is authorized and directed to execute a Professional Consultant Services Agreements with Hinderliter, de Llama and Associates for Sales, Use Tax, Transient Occupancy Tax and Business Tax Services in an amount not to exceed $521,535, plus an annual escalator and contingent fees, for a term of five (5) years with two additional optional one-year extensions exercisable in the City Manager’s discretion in a form substantially similar to that presented to the City Council on February 4, 2025.
Section 4. That a five-year Professional Services Agreement is hereby awarded to HdL Coren & Cone for Property Tax Services.
Section 5. That the City Manager is authorized and directed to execute a Professional Consultant Services Agreement with HdL Coren & Cone for Property Tax Services in an amount not to exceed $105,000, plus an annual escalator and contingent fees, for a term of five (5) years with two optional one-year extensions exercisable in the City Manager’s discretion in a form substantially similar to that presented to the City Council on February 4, 2025.
Section 6. That a 19% project contingency for the tax and fee consulting project is hereby approved. The City Manager is authorized to utilize the project contingency to the extent necessary and proper for additional services at the rates set forth in such agreements.
Section 7. That City staff is authorized and directed to execute such other documents and take such other and further actions as are necessary and proper to accomplish the purposes of this resolution.
Section 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
