RESOLUTION NO. 25-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AND FILING NOTICE OF COMPLETION FOR THE PRIMA DESHECHA CANADA CHANNEL (FACILITY NO. M01) WALL STABILIZATION AT GRANDE VISTA, PROJECT NO. 15007 WHEREAS, in February 2024, due to heavy rains the Prima Deshecha Canada Channel experienced a wall failure and an emergency repair was completed to temporarily stabilize the area; and WHEREAS, on November 17, 2024, the City Council awarded a construction contract to BOSCO Constructors, Inc. for the Prima Deshecha Canada Channel (Facility No. M01) Wall Stabilization at Grand Vista, CIP Project No. 15007; and WHEREAS, the project consisted of removing the debris remaining, removing the temporary repair materials, stabilizing the slope, and constructing a new channel wall, and has been completed.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That the Prima Deshecha Canada Channel (Facility No. M01) Wall Stabilization at Grande Vista, Project No. 15007, is hereby accepted from BOSCO Constructors, Inc.
SECTION 3. That the Public Works Director/City Engineer is authorized and directed to execute and record the Notice of Completion for the Prima Deshecha Canada Channel (Facility No. M01) Wall Stabilization at Grande Vista, Project No. 15007.
SECTION 4. That the City Clerk is authorized and directed to release the payment bond for this project 30 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, BOSCO Constructors, Inc.
SECTION 5. That the City Clerk is authorized and directed to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director in the amount of 25% of the total construction cost.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
