SECOND AMENDMENT TO
EMPLOYMENT AGREEMENT BETWEEN THE CITY OF SAN CLEMENTE AND GARY ANDREW “ANDY” HALL This Second Amendment to Employment Agreement between the City of San Clemente and Gary Andrew “Andy” Hall (this “First Amendment”) is made and entered into on this 4th day of March 2025, by and between the CITY OF SAN CLEMENTE, a California municipal corporation (“City”), and Gary Andrew “Andy” Hall l (“Hall”) in order to modify, in writing, the terms and conditions of the City’s employment of Hall effective February 18, 2025.
R E C I T A L S:
City and Hall entered into an Employment Agreement (“Agreement”) on February 20, 2023; Effective February 20, 2024, the City and Mr. Hall entered into that certain First Amendment to Employment Agreement (“First Amendment”); and City and Hall desire to amend the Agreement, as amended by the First Amendment, in the manner provided herein.
C O V E N A N T S:
Section 1. Section 5A of the Agreement is hereby deleted and replaced in its entirety with the following:
“A. Effective February 18, 2025, City agrees to pay Hall for services rendered an annual base salary of __________ thousand, ________ hundred, ______ dollars ($_______). Said amount shall be subject to annual base salary increases as identified in Article I – Wages of the Memorandum of Understanding (MOU) between the City of San Clemente and the San Clemente City Employees’ Association (SCCEA) adopted August 20, 2024 and future SCCEA MOUs, and shall be payable in bi-weekly installments at the same time and in the same manner as other City employees are paid. Additionally, at a public, regular meeting of the City Council, the City Council can agendize as a non-consent item, an amendment to this Agreement increasing the City Manager’s base salary payable under Section 5A.
Section 2. Except as expressly amended by this Second Amendment, the remaining portions of the Agreement, as amended by the First Amendment, shall remain in full force and effect. [SIGNATURES ON FOLLOWING PAGE]
