1. MINUTES
A. Review and file minutes of the Design Review Subcommittee (DRSC) meeting January 29, 202.
Member Cosgrove moved to approve the amended Minutes. Chair Camp seconded the motion to approve the December 18, 2024 Minutes. Motion passed 2-1, Vice Crandell abstained.
2. ARCHITECTURAL REVIEW OF THE FOLLOWING ITEMS:
A. Public Hearing Project (PHP) 24-219, Wach Residence, 217 Esplanade A request to allow the addition of a 55 sq. ft. bathroom, new windows, exterior improvements, and maintenance items to an approximately 2,156 sq. ft. historic home non-conforming to required side setbacks and parking located at 217 Esplanade. The improvements are required pursuant to a previously approved Historic Property Preservation Agreement (HPPA).
Principal Planner Rehm summarized the staff report and provided a presentation on the project.
Chair Camp opened the item for public comments.
Applicant, Christian Wach, commented in favor of the project, describing the architectural selections, site improvements, and consistency with the Historic Property Preservation Agreement.
1 Agenda Item: 11B(5)
Design Review Subcommittee Meeting Minutes March 12, 2025 Page 2 The Design Review Subcommittee, also serving as the Cultural Heritage Subcommittee in its review of the historic property, discussed the project, and made the following comments either individually or as a group:
• Structure should be designed in a way that allows for easy removal in the future if needed. Expansion joints could help in addition area, but not required. • The addition should not encroach into the setback at grade, but the cantilevered bay window design is an allowable encroachment. Second alternative with a single plane pop-out rather than two new planes is preferable.
• Window placement is good, should be minimalist, potential to extend the popout up to the roofline to make it look more intentional. • The design should maintain the character of the Spanish Colonial Revival style, and maintain and restore original features rather than replace them. • A gloss finish over the aged, natural patina door and other surfaces is preferred rather than refinishing them to look brand new.
• The project is incorporating historical preservation requirements (HPPA), but more work and staff/Cultural Heritage Subcommittee review may be required in the future.
The Subcommittee encouraged the applicant to consider the comments and make any revisions on the plans before a Zoning Administrator public hearing.
B. Public Hearing Project (PHP) 24-446, Dish Wireless Telecommunications Facility, 800 S. El Camino Real
A request to install a wireless telecommunications facility on a two-story commercial building, consisting of six roof-mounted panel antennas and rooftop equipment behind roof parapet screen walls. The site is located at 800 S. El Camino Real.
Senior Planner Wright summarized the staff report.
Chair Camp opened the item for public comments.
Applicant, Franklin Orozco, commented in favor of the project, describing the architectural changes and the site selection process. Alternative sites were considered for the facility but Mr. Orozco stated the proposed site provided the best means to meet coverage needs.
The Design Review Subcommittee (DRSC) discussed the project, and made the following comments either individually or as a group:
• The applicant should provide transmission coverage maps for the public hearing that demonstrate the proposed facility location is necessary to provide an unmet need in wireless coverage.
2 Design Review Subcommittee Meeting Minutes March 12, 2025 Page 3 • Locate the antennas and equipment on the sides of the building within an architectural roof screen that involves replacing the parapet with radio transmission material and building up the roof as minimally as possible. The screen would mimic an equipment enclosure with a design that is integrated in the building. The width should be approximately equal to a tenant suite in the building so the roof screens appear to be an architectural element versus looking out of place.
• Locate the antennas and equipment within roof screens centered on the roof so they are less visible. This may involve replacing portions of the roof parapet to have radio transmission material so the antennas have the reach to provide the intended transmission coverage.
• The current proposed design involves modifying the parapet above the entrance canopy by increasing its height and mass. If the facility is built into the canopy, several design changes should be made. First, rather than increase the canopy’s height, it is preferential to extend the parapet downward to fill in the space between the canopy and the top of the roof parapet. If this isn’t sufficient for antenna screening, then increase the canopy’s height minimally. Second, the parapet changes should be symmetrical on both sides and fully screen the proposed equipment. Third, the columns should be widened so they appear more supportive of the canopy’s roofline with the proposed changes. Fourth, the parapet changes should extend to the rear of the building as feasible so the proposed changes do not look out of place.
The Subcommittee encouraged the applicant to consider the comments and make design revisions before the public hearing. If adequate changes are made, the project will be forwarded to the Zoning Administrator for a decision.
Otherwise, a Planning Commission decision will be required.

A. Continued Public Hearing Project (PHP) 24-576, Pentegna Residence, 107 West Avenida Cadiz
A continued public hearing to request the Zoning Administrator to approve a Development Permit 25-042 for a 182 sq. ft. addition, new 50 sq. ft. covered porch, and interior remodel of an existing single-family residence adjacent to a historic resource. Also for consideration is a request for a Minor Exception Permit 25-063 to permit an existing over-height patio wall and guardrail, that is not stepped back to code, located in the front yard setback.
The Zoning Administrator will also consider whether the project is Categorically Exempt from the requirements of the CEQA pursuant to CEQA Guidelines § 15301 (Class 1: Existing Facilities) and §15303 (Class 3: New Construction or Conversion of Small Structures).
DRAFT
1 Agenda Item: 11B(6)
Minutes of the Zoning Administrator Regular Meeting March 20, 2025 Page 2 Assistant Planner Gatny summarized the staff report and introduced the applicants and owners, Steven and Diane Pentagna.
ZA Atamian opened the public hearing and asked the applicants if they would like to make a presentation. Mr. Pentagna stated:
• The deck was an attractive feature and part of the reason they purchased the house, the nonpermitted deck extension was not disclosed to them when they purchased the home.
• Applicant disagrees with staff’s assessment regarding the deck design having a negative aesthetic effect on the neighboring properties. Noted that most neighbors have provided written support for the deck.
• It would cause a hardship to modify the wall, as it costs substantial amount of money.
• In regards to landscaping, more landscaping could be added and are open to suggestions to improve the aesthetics.
ZA Atamian stated he reviewed the staff report and is familiar with the project. ZA Atamian noted that there is a legal recourse that the owners could persue against the real estate agent that did not disclose the nonpermitted work, although, the sellers may have not thought there was a violation. A building permit may be required to ensure the deck was built properly to the building code. The stepping back to code is relatively minor but the guardrail is more prominent now that the previous landscaping is gone, which opens and improves the views of the historic resource. The guardrail is a still a predominate feature and could be softened with the addition of a climbing vine.
ZA Atamian stated:
• In regards to the Development Permit, the addition is generally retaining the same mass and scale from the street view. • In regards to the Minor Exception Permit, the proposed wall is in keeping with the general appearance of other front yard walls in the vicinity, including retaining walls that create a larger usable front yard area, and thus is in character of the neighborhood.
• The guardrail is chunky and would benefit from added vines, not to exceed the height of the guardrail.
• An Encoarchment Permit is required for short wall in the right-of-way.
If it is determined that some of the wall needs to be modified or removed, it is still the applicants responsibliltiy to maintain the climbing vines.
ZA Atamian thanked staff for the report and Resolution that supported the following Findings:
• The proposed project is consistent with the General Plan. • The proposed project complies with zoning regulations. • This is a modest addition.
• The views of the historic resource are improved by the open guardrail design.
DRAFT
2 Minutes of the Zoning Administrator Regular Meeting March 20, 2025 Page 3 • The proposed project is consistent with the City’s Design Guidelines. • The proposed development will not be detrimental to the public health, safety or welfare, or materially injurious to properties and improvements in the vicinity.
There being no further questions of staff or the applicants, ZA Atamian closed the public hearing.
ZA Atamian determined the project Categorically Exempt from CEQA pursuant to State CEQA Guidelines §15301 (Class 1: Existing Facilities) and §15303 (Class 3: New Construction or Conversion of Small Structures).
Action: The Zoning Administrator adopted Resolution ZA25-004 approving Development Permit 25-042 and and Minor Exception Permit 25-063, Pentegna Residence, 107 West Avenida Cadiz, subject to the Conditions of Approval, with a modification to replace Condition COA 4.2 in its entirety with the following language: “The applicant shall install and maintain climbing vines in the front planter most adjacent to the sidewalk that do not exceed the height of the guardrail and cover at least 75% of the portion of the guardrail parallel to and facing the sidewalk. The applicant shall also install the vine along the guardrail return facing the adjacent historic property, subject to the concurrence of the historic property owner.”

A. Public Hearing Project (PHP) 25-107 Smith Residence Addition, 145 Trafalgar Lane
A special public hearing to request the Zoning Administrator to approve a 420 square foot addition of living area to include a new master bedroom, bath, closet; and a detached 447 square foot 2-car garage addition to a residence located at 145 Trafalgar Lane that is adjacent to a historical single-family residence at 143 Trafalgar Lane. The proposed project is in the Residential Low Zone (RL), and the Coastal Zone (CZ) Overly, however, since it is in the Categorical Exclusion area and the project is associated with an addition to an existing single-family residence and does not propose a new residential unit, it does not require a Coastal Development Permit from the California Coastal Commission.
The Zoning Administrator will also consider whether the project is Categorically Exempt from the requirements of the CEQA pursuant to CEQA Guidelines § 15301 (Class 1: Existing Facilities) and §15303 (Class 3: New Construction or Conversion of Small Structures).

1 Agenda Item: 11B(7)
Minutes of the Zoning Administrator Special Meeting March 24, 2025 Page 2 Assistant Planner Coury summarized the staff report and introduced the applicant and owner, Douglas Smith, who is also the owner of the neighboring historical resource at 143 Trafalgar Lane.
Principal Planner Rehm advised ZA Atamian that the Staff Report was revised from the posted report and that all parties have received the updated materials.
ZA Atamian asked the applicants if they would like to make a presentation and Mr. Smith stated he was pleased with staff’s report.
ZA Atamian thanked staff for the report and stated the following:
• ZA Atamian disclosed that he drove by the property, and is familiar with the project site and neighborhood;
• ZA Atamian reviewed the project’s proposed plans;
• ZA Atamian reviewed the updated staff report and noted that the vicinity map labeled as Attachment 2 is incorrect, and requested that staff revise the report for historical records;
• ZA Atamian stated that he is aware that the project is being brought forward as a special meeting because there were issues with timing and that staff has been successful in guiding the project through the process;
• ZA Atamian has not received any public comments on the proposed project;
• ZA Atamian confirmed that the applicant is also the owner of the historical resource next door;
• ZA Atamian stated that under the current Building Code, the carport does not comply; and therefore constructing a garage will make the property more Code Compliant;
• ZA Atamian stated that the garage location in the rear yard will not impact the historic resource or affect public view; and • That the Findings as stated in the Resolution can be met There being no further questions of staff or the applicants, ZA Atamian closed the public hearing.
ZA Atamian determined the project Categorically Exempt from CEQA pursuant to State CEQA Guidelines §15301 (Class 1: Existing Facilities) and §15303 (Class 3: New Construction or Conversion of Small Structures).

CITY COUNCIL MEETING

Meeting Date: April 1, 2025 Agenda Item: 11D.

Prepared By: Zak Ponsen, Assistant City Engineer
Subject:

CONSIDERATION OF A RESOLUTION APPROVING FINAL PARCEL MAP 2023-201, 501 ELENA LANE CONDOMINIUM SUBDIVISION ..body
Fiscal Impact:
None.
Summary:
Camino Valencia, LLC, the property owner and Subdivider of Final Parcel Map 2023-201, has submitted the Final Parcel Map for City Council approval. Staff has confirmed that the proposed Final Parcel Map is in conformance with the approved Tentative Parcel Map. Pursuant to the Subdivision Map Act, a legislative body shall not deny approval of a Final Parcel Map if it has previously approved a Tentative Parcel Map for the proposed subdivision and if it finds that the Final Parcel Map is in substantial compliance with the previously approved Tentative Parcel Map.
Thus, while the Subdivision Map Act and San Clemente Municipal Code Chapter 16 require City Council action to approve the Final Parcel Map, that action is ministerial.
Background:
Parcel Map 2023-201 contains two residential condominium dwelling units on one 4,966 squarefoot lot (see attached Location Map). The California Coastal Commission approved a De Minimis waiver on October 15, 2024. The Conditions, Covenants and Restrictions (CC&Rs) for the project have been reviewed and approved by the City Attorney and the Subdivider has reimbursed the City for the costs of that review as required by the Conditions of Approval.
Included on the Final Map is an offer of dedication of a 2.5-foot-wide easement for sidewalk and public access purposes along Elena Lane. The City Engineer has reviewed and is satisfied with the quitclaims in favor of the City that the Subdivider obtained from all persons having any interest in existing rights of way for pipelines for the conveyance of water, and for all rights to all underground water. The Subdivider has satisfied all other Conditions of Approval that are required prior to Final Parcel Map approval. The only remaining action for satisfying the Conditions of Approval is for the Subdivider to record the CC&Rs, which will be recorded immediately after the Final Parcel Map. Copies of the proposed Final Parcel Map and approved Tentative Parcel Map are available for review at City Hall in the Public Works, Engineering Division.
Council Options:
Adopt Resolution No. 25-36 (Attachment 2), approving Final Parcel Map 2023-201, accepting a sidewalk and pedestrian access easement and water rights as dedicated. 1 Meeting Date: April 1, 2025 Agenda Item: 11D.
CITY OF SAN CLEMENTE
Modify and adopt Resolution 25-36.
Continue the item and direct staff to provide additional information. Deny Resolution No. 25-36 pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications. Per Subdivision Map Act (Government Code section 66474.1), a legislative body shall not deny approval of a Final Parcel Map if it has previously approved a Tentative Parcel Map for the proposed subdivision and if it finds that the Final Parcel Map is in substantial compliance with the previously approved Tentative Parcel Map. The Tentative Parcel Map 2023-201 was approved by the Zoning Administrator on July 18, 2024 through Resolution ZA 24-011. See Attachment 3. Unless the City Council finds that the Final Parcel Map is not in substantial compliance with the previously approved Tentative Parcel Map, approving the Final Parcel Map is a ministerial action.
Environmental Review/Analysis:
This project was previously found Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301.k (Class 1: Existing Facilities) in connection with the approval of the Tentative Parcel Map. The approval of a Final Parcel Map is a ministerial action and not a “project” under CEQA.
Recommended Actions:
Staff recommends that the City Council approve Resolution No. 25-36, which would:
1. Approve the Final Parcel Map 2023-201 as it conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map;
2. Accept on behalf of the City of San Clemente the sidewalk and pedestrian access easement as dedicated;
3. Accept on behalf of the City of San Clemente the water rights as dedicated;
4. Authorize and direct the Public Works Director/City Engineer to sign the Final Parcel Map; and
5. Authorize and direct the City Clerk to sign and submit the Final Parcel Map for recordation with the County of Orange Recorder’s Office...recommendation ..end

6 STAFF REPORT
SAN CLEMENTE ZONING ADMINISTRATOR
Meeting Date: July 18, 2024
PLANNER: Zach Rehm, Principal Planner
SUBJECT: Public Hearing Project (PHP) 24-024, Tentative Parcel Map (TPM) 24-030, 501 Elena Lane Condominium
Subdivision, a request to allow a duplex condominium
subdivision for individual ownership of two dwelling units as identified within County of Orange File No. 2023-201, and finding that the project is Categorically Exempt from the California Environmental Quality Act.
LOCATION: 501 Elena Lane (APN 692-044-25)
ZONING/GENERAL
PLAN:
Residential Medium (RM) Zoning District and General Plan Classification; Coastal Zone (CZ) Overlay, and Architectural (A) Overlay
PROJECT SUMMARY:
x The site is 4,966 square foot corner lot, with street frontage along Elena Lane and Avenida Madrid, sloping downward to the west side of the lot towards the ocean. x The site is developed with a duplex authorized by Building Permit B22-0658, which has not been finaled. The duplex includes two parking spaces per unit, accessed from a shared driveway along Avenida Madrid, which meets zoning code requirements. x The RM zone permits one dwelling unit per 1,800 square feet of lot area, so two dwelling units are the maximum that may be authorized on the subject site. x The applicant requests to subdivide the airspace of the lot to allow for two condominium units, each approximately 2,675 square feet. The proposal would allow for separate ownership of each condominium unit and a portion of common areas. x A four-foot wide sidewalk is being constructed in the City right-of-way along Avenida Madrid as part of the approved plans for the duplex. Condition 2.37 would require the property owner to grant a sidewalk easement along Elena Lane and construct a sidewalk in that location unless a waiver is granted by the City Manager. The applicant has identified a 2.5 foot wide sidewalk easement along Elena Lane on the proposed plans, to supplement the 1.5-to-2 feet of City right-of-way extending to the curb, for construction of a four-foot wide sidewalk by the applicant or by the City in the future. t

7 501 Elena Lane Condominium Subdivision Page 2
x Approval Authority: Municipal Code Section 16.04.015(G)(1) requires Zoning Administrator approval of Tentative Parcel Map applications for condominium subdivisions.
x Project Findings: The project meets required findings and staff supports the proposed request based on the following:
o The project is limited to subdividing the lot’s airspace to allow for separate ownership of two condominium units and does not have any potential environmental impacts.
o The City limits the number of annual condominium conversions that can occur; however, per SCMC 16.14.010, that restriction “shall not apply to condominium projects involving buildings which have not been previously occupied or buildings for which the City has not issued a final inspection or certificate of occupancy for a use other than condominiums”. As the duplex at this property is still under construction, these units are not subject to (and do not count towards) the annual limit on conversions.
o Conditions of approval are included requiring Covenants, Conditions, and Restrictions (CC&Rs) to establish maintenance responsibilities over all common areas, including driveways, parking, landscaped areas, walls, private accesses, and drainage. The CC&R’s may include the creation of an Association. o The proposal complies with the Municipal Code, building, health, and safety codes, and other applicable regulations and policies. This includes, but is not limited to, parking and density requirements for condominium subdivisions in the Municipal Code (Title 16).
x Public Comment: Public comments have not been received on this item. x Coastal Act: The site is within the Coastal Zone, within the Categorical Exclusion Order Area, but subdivisions/parcel maps are not an excluded category of development; therefore the project requires review and approval by the California Coastal Commission. The project is not subject to the Mello Act in that there are no occupied residences at the subject site. The approved duplex under construction improves a vacant lot, and the condominium conversion does not remove or convert any occupied housing units, including affordable units, within the Coastal Zone. x CEQA: The project is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301 (Class 1: Existing Facilities):
o The project involves the subdivision of airspace for two condominium units in an urbanized area zoned for multi-family residential use.
o The project conforms to the San Clemente General Plan and Zoning Ordinance, and no variances or exceptions are required.
o All public services and access to the project site are available. o The site was not involved in a division of a larger parcel within the last two years. o The parcel does not have an average slope greater than 20 percent. 8 501 Elena Lane Condominium Subdivision Page 3
RECOMMENDATION:
Based on the information in the staff report and subject to the required findings and conditions of approval, staff recommends that the Zoning Administrator:
1. Determine the project is Categorically Exempt from the requirements of the CEQA pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301 (Class 1: Existing Facilities); and
2. Adopt Resolution ZA 24-011, approving Public Hearing Project (PHP) 24-024 for Tentative Parcel Map 24-030, 501 Elena Lane Condominium Subdivision, subject to conditions of approval.

The site’s legal description is LOT 9 IN BLK 2 OF TR 785 and the Assessor’s Parcel Number is 692-044-25; and WHEREAS, the Planning Division has completed an initial environmental assessment of the above matter in accordance with the California Environmental Quality Act (CEQA) and recommends the Zoning Administrator determine the project is Categorically Exempt from CEQA pursuant to State CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and Guidelines Section 15301 (Class 1: Existing Facilities). This is recommended because the project involves a two-unit condominium subdivision of a duplex in an urbanized area and no exceptions identified in CEQA Guidelines Section 15300.2 are applicable; and
WHEREAS, on February 22, 2024, and February 29, 2024 the City's Development Management Team (DMT) reviewed the proposed project, and staff issued comments on February 29, 2024 to ensure compliance with the General Plan, Zoning Ordinance, and other applicable City ordinances and codes; and
WHEREAS, in accordance with City and State requirements, notice of the public hearing was published in the San Clemente Times newspaper on July 3, 2024, posted at the project site, and mailed to all property owners within 300 feet of the subject parcel; and
WHEREAS, on July 18, 2024, the Zoning Administrator of the City of San Clemente held a duly noticed public hearing on the subject application, considered written and oral comments, and facts and evidence presented by the applicant, City staff, and other interested parties.
NOW, THEREFORE, the Zoning Administrator of the City of San Clemente does hereby resolve as follows:
$WWDFKPHQW
10 Resolution No. ZA 24-011 Page 2
Section 1. Incorporation of Recitals.
The Zoning Administrator hereby finds that all of the facts in the Recitals are true and correct and are incorporated and adopted as findings of the Zoning Administrator as fully set forth in this resolution.
Section 2. CEQA Findings.
Based upon its review of the entire record, including the Staff Report, any public comments or testimony presented to the Zoning Administrator, and the facts outlined below, the Zoning Administrator hereby finds and determines that the proposed project is Categorically Exempt from CEQA pursuant to State CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and Guidelines Section 15301 (Class 1: Existing Facilities).
The project is Categorically Exempt from California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15315 (Class 15, Minor Land Divisions) because the project involves the subdivision of two dwelling units, for individual ownership, in an urbanized area zoned for residential use. The airspace subdivision is in conformance with the General Plan, Subdivision Map Act, and zoning; no variances or exceptions are required, all public services and access to the proposed condominium units to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent.
Section 3. Tentative Parcel Map Findings
With respect to Tentative Parcel Map (TPM) 24-030, the Zoning Administrator finds as follows:
A. The site is physically suitable for the type of development, in that:
1. The project is limited to subdividing the airspace of a duplex into two condominium units for individual ownership purposes; and
2. There is an active building permit at the site to construct a new duplex. The building permit has been reviewed to ensure that the development complies with the Zoning Ordinance, building, health, and safety codes, and other applicable regulations and policies. This includes but is not limited to policies and regulations on land use, setbacks, utility connections, easement access, traffic design standards, et al.
B. The site is physically suitable for the proposed density of the development, in that:
1. The proposed density on the site complies with the maximum allowed for properties in the RM zoning district. The zoning district allows a maximum residential density of one unit per 1,800 square feet of lot area. The subject site is 4,966 square feet, with an allowed density of two units. 11 Resolution No. ZA 24-011 Page 3
C. The design of the condominium conversion or the proposed improvements is not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, in that:
1. The project is limited to subdividing airspace into two condominiums to allow for separate ownership of each dwelling unit;
2. No physical modifications to the site will result from the proposed subdivision except for construction of a sidewalk along Elena Lane, which is already developed with a street; and
3. The site is in a developed residential area served by existing utilities and public services.
D. The design of the condominium subdivision or the type of improvements is not likely to cause serious public health problems, in that:
1. The project is limited to subdividing the airspace of a duplex into two condominiums to allow for separate ownership of each dwelling unit;
2. No physical modifications to the site will result from the proposed subdivision except for construction of a sidewalk along Elena Lane, which is already developed with a street; and
3. The site is in a developed residential area served by existing utilities and public services.
E. The condominium subdivision, with its provisions for any design and improvements, is consistent with the General Plan, in that:
1. The project is limited to subdividing the airspace of a duplex into two condominium units for individual ownership purposes. The project is consistent with the Residential Medium General Plan Land Use Classification of the site; and
2. There is an active building permit at the site to construct a new duplex. The building permit has been reviewed to ensure that the development complies with the Zoning Ordinance, building, health, and safety codes, and other applicable regulations and policies. This includes but is not limited to policies and regulations on land use, setbacks, utility connections, easement access, traffic design standards, et al; and
3. The City limits the number of annual condominium conversions that can occur; however, per SCMC 16.14.010, that restriction “shall not apply to condominium projects involving buildings which have not been previously occupied or buildings for which the City has not issued a final inspection or certificate of occupancy for a use other than condominiums”. As the duplex at this property is still under construction, these units are not subject to (and do not count towards) the annual limit on conversions.
12 Resolution No. ZA 24-011 Page 4
F. The design of the condominium subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision in that:
1. The proposed project is limited to subdividing a duplex into two condominium units for individual ownership purposes;
2. Easements for sidewalks along Elena Lane and Avenida Madrid have been identified on the tentative map; and
Section 4. Zoning Administrator Approval.
Based on the foregoing recitals and findings above, and the written and oral comments, facts, and evidence presented, the City of San Clemente Zoning Administrator approves Tentative Parcel Map 24-030, 501 Elena Lane Condominium Subdivision, subject to the Conditions of Approval set forth in Exhibit A.
PASSED AND ADOPTED at a regular meeting of the City of San Clemente Zoning Administrator on July 18, 2024.

A. Sidewalk along both the properties frontages, including construction of compliant sidewalk around drive approach or other obstructions to meet current City standards (2% cross fall) when adequate right-of-way exists. Since the street right-of-way is approximately 2 feet behind the curb face along Elena Lane, a sidewalk easement is required to be granted to the City unless a waiver is formally applied for and approved by the City Manager. Sidewalk is currently being constructed along the Avenida Madrid frontage as
part of the approved construction permits, but it lacks the ADA compliance width around the drive approaches due to the lack of right-of-way. Since, the street right-of-way varies from 5 to 7 feet behind the curb face along Avenida Madrid, a sidewalk easement is required to be granted to the City unless a waiver is formally applied for and approved by the City Manager.
B. Contractor shall replace any damaged street improvements resulting from construction activities to the satisfaction of the City Inspector.

CONSIDERATION OF A RESOLUTION DECLARING SURPLUS AND APPROVING DISPOSITION OF RETIRED FLEET EQUIPMENT & VEHICLES ..body Fiscal Impact:
The fiscal impact will depend on bid prices; however, staff has projected approximately $160,000 based on past auction sales. These net proceeds from the auction of surplus equipment and vehicles will be placed into the Fleet Fund Replacement Reserve and recognized as revenue in Account No. 065-000-39110. The costs for the auction services will be deducted from the gross proceeds of the sale.
Summary:
Before the City Council is a resolution declaring the City-owned equipment and vehicles listed on Attachment No. 1 are surplus and authorizing the services of JJ Kane dba Ken Porter Auctions for the disposal of such surplus equipment and vehicles.
Background:
The City’s Fleet Fund periodically retires end-of-life vehicles and fleet equipment. A third-party auction house provides the disposition services on behalf of the City.
Fleet equipment and vehicles are reviewed annually by the Fleet Manager and City staff to determine if equipment and vehicles have reached the end of their useful lives and should be replaced. As equipment and vehicles are replaced, retired fleet units are accumulated at the Corporate Yard to await proper disposal.
The City utilizes a third-party auction company to list, sell, and complete all necessary documentation to transfer title of the retired vehicles and equipment. The last auction of surplus vehicles occurred in June 2024. Twenty vehicles and pieces of equipment have been retired from service since that time, which now await proper disposition. In order to address parties who may be interested in bidding on these vehicles, City staff will publish the auction information when it becomes available.
Proceeds from the sale of surplus equipment and vehicles will be placed in the Fleet Replacement Reserve to offset unforeseen or excess fleet replacement costs.
Council Options:
Adopt Resolution No. 25-37, declaring the vehicles and equipment listed on Attachment No. 1 surplus and authorizing disposition using the services of Ken Porter Auctions. 1 Meeting Date: April 1, 2025 Agenda Item: 11E.
