RESOLUTION NO. 25-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF San clemente, CALIFORNIA, approving the 2025-2029 consolidated plan with amended citizen participation plan and 2025-2026 annual action plan, authorizing submission of the plan to the u.s. department of housing and urban development, and receiving and filing the 2025-2029 oRANGE cOUNTY aSSESSMENT OF fAIR hOUSING WHEREAS, the City of San Clemente is eligible to participate in the Community Development Block Grant (“CDBG”) Program; and WHEREAS, to receive CDBG funds, the City is required to prepare a five-year Consolidated Plan for Fiscal Years 2024-2025 through 2029-2030; and WHEREAS, the Consolidated Plan will identify the City’s overall housing and community development needs, outlining specific goals and objectives that will guide the City's CDBG funding priorities over a multi-year period; and WHEREAS, the Annual Action Plan, a component of the Consolidated Plan, is updated each fiscal year and includes the application to the U.S. Department of Housing and Urban Development ("HUD") for CDBG funds and required certifications related to the receipt and use of CDBG funds; and WHEREAS, the actual use of CDBG funds for specific projects and programs may require the execution of additional forms and certifications by a duly authorized representative of the City; and WHEREAS, HUD has not yet indicated the actual amount of funds available for the City, so the City has had to make a reasonable estimation thereof; and WHEREAS, to affirmatively further fair housing initiatives, the City participated in the preparation of the 2025-2029 Orange County Regional Assessment to Fair Housing (“OC-AFH”), which will be a key point of reference on fair housing matters within the City; and WHEREAS, as a recipient of CDBG funds, the City is required to maintain a Citizen Participation Plan that outlines the policies and procedures to encourage the participation of the public in the implementation of the CDBG program.
NOW THEREFORE, the City Council of the City of San Clemente, California, does hereby find, determine, and resolve as follows:
Section 1. The City Council hereby approves the 2025-2029 Consolidated Plan with the amended Citizen Participation Plan, 2025-2026 Annual Action Plan, and the 2025-2029 Orange County Regional Assessment of Fair Housing, copies of which are attached to the agenda report dated May 6, 2025, entitled “Public Hearing to Consider the Adoption of the 2025-2029 Consolidated Plan including the amended Citizen Participation Plan and 2025-2026 Annual Action Plan for expenditures of Community Development Block Grant funds, and the 2025-2029 Orange County Regional Assessment of Fair Housing,” and are incorporated herein fully by this reference.
Section 2. The City Manager, or the City Manager’s designee, is authorized to submit the 2025-2029 Consolidated Plan with the amended Citizen Participation Plan and 2025-2026 Annual Action Plan to HUD on behalf of the City.
Section 3. The City Manager, or the City Manager’s designee, is hereby authorized and directed to approve and execute any and all HUD-and/or CDBG-related applications, certifications, agreements, and/or other documents or instruments and take such actions as are necessary and proper to implement the approvals and authorizations as set forth herein, including but not limited to proportionally increasing or decreasing the estimated CDBG allocations for approved activities identified in the 2025-2026 Annual Action Plan to match the City’s actual 2025-2026 CDBG allocation once determined, approved, and announced by HUD.
Section 4. The City Manager, or the City Manager’s designee, is hereby authorized to accept the final HUD-allocated grant revenues, estimated at $312,427, to Fund 017 - CDBG Grants Fund, and the actual amounts of the same so granted.
Section 5. The City Manager, or the City Manager’s designee, is hereby authorized and directed to allot a related budget appropriation of the final HUD-allocated grant revenues, estimated at $312,427, to the CDBG fund for the amounts in the 2025-2026 Annual Action Plan.
Section 6. The City Clerk shall certify to the passage and adoption of this resolution and enter in into the book of original resolutions.
