RESOLUTION NO. 25-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO ROY ALLAN SLURRY SEAL, INC. TO PERFORM FY 2025 MAJOR STREET MAINTENANCE, CIP PROJECT NO. 25303, IN AN AMOUNT NOT TO EXCEED $370,517, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT, APPROVING A 15% PROJECT CONTINGENCY, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, the City conducted formal competitive bidding for the FY 2025 Major Street Maintenance, CIP Project No. 25303 (Project); and WHEREAS, on April 10, 2025, the City received five (5) responsive bids ranging from $370,516.83 to $546,000.00 for the Project; and WHEREAS, Roy Allan Slurry Seal, Inc. was the lowest responsive and responsible bidder with a bid of $370,516.83.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That based upon substantial evidence in the record as a whole, the Project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repairs to existing City facilities, involves negligible or no expansion of existing or former use and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.
SECTION 3. That the Construction Contract Agreement for the FY 2025 Major Street Maintenance, CIP Project No. 25303, is hereby awarded to Roy Allan Slurry Seal, Inc.
SECTION 4. That the City Manager is authorized and directed to execute a construction contract for the FY 2025 Major Street Maintenance, CIP Project No. 25303 with Roy Allan Slurry Seal, Inc. in an amount not to exceed $370,517, in a form substantially similar to that presented to City Council on May 6, 2025.
SECTION 5. That a 15% project contingency of $55,577 is hereby approved and may be utilized to the extent that the City Manager determines it necessary and proper.
SECTION 6. That the City Manager is authorized and directed to take such other and further actions as are necessary and proper to accomplish the purposes of this resolution and complete the project.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
