RESOLUTION NO. 25-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO ONYX PAVING COMPANY, INC. TO PERFORM SOUTH EL CAMINO REAL LANE RECONFIGURATION AND BUFFERED BIKE LANE PROJECT FROM AVENIDA MENDOCINO TO SOUTH CITY LIMIT IN AN AMOUNT NOT TO EXCEED $1,639,000, APPROVING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $848,900, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT, APPROVING A 10% PROJECT CONTINGENCY, AND MAKING FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the 2014 adoption of the Centennial General Plan and Bicycle and Pedestrian Master Plan included candidate project number 4 to add Class II bike lanes on South El Camino Real from Avenida Mendocino to its southerly terminus; and WHEREAS, the potentially significant environmental impacts of the 2014 Centennial General Plan and the Bicycle and Pedestrian Master Plan were fully analyzed and evaluated under the California Environmental Quality Act (CEQA) in an Environmental Impact Report, SCH No. 2013041021, including candidate project number 4 to add Class II bike lanes on South El Camino Real from Avenida Mendocino to its southerly terminus; and WHEREAS, on November 7, 2018, the City adopted Resolution 18-42 authorizing the application for federal grant funds from the Congestion Mitigation and Air Quality Improvement Program Fund; and WHEREAS, on February 16, 2021, the City adopted Resolution 21-003 approving a General Plan Amendment to authorize the reclassification of South El Camino Real from Avenida Mendocino to its southerly terminus from a Secondary to a Divided Collector; and WHEREAS, the City determined that the February 16, 2021 amendments to the General Plan did not constitute changes to the Project or circumstances or new information that could create new or more severe environmental impacts needing subsequent or supplemental environmental analysis beyond the analysis contained in the 2014 Environmental Impact Report and that the amendments were exempt from CEQA in any event; and WHEREAS, the Orange County Transportation Authority (OCTA) has amended the Orange County Master Plan of Arterial Highways (MPAH) map to reclassify the segment of South El Camino Real from Avenida Mendocino to the southerly terminus as a Divided Collector; and WHEREAS, extensions for project funding were granted by Caltrans and OCTA due to regulatory permitting delays, COVID, project staffing, and project timeline conflicts with concurrent Caltrans projects on the I-5 Freeway; and WHEREAS, per the Amended General Plan approval, the project design will not modify the physical layout of the roadway segment and only include pavement marking modifications so that adequate emergency access can still be provided; and WHEREAS, the City conducted formal competitive bidding for the South El Camino Real Lane Reconfiguration & Buffered Bike Lane Project, Federal Project No. CML-5274(039), FTIP No. ORA 190914, City CIP Project No. 11308 (Project); and WHEREAS, on July 11, 2024, the City received six (6) responsive bids ranging from $1,639,000 to $1,889,465 for the Project; and WHEREAS, ONYX Paving Company, Inc. was the lowest responsive and responsible bidder with a bid of $1,639,000.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the above recitations are true and correct and incorporated fully herein.

SECTION 2. Based on the record as a whole, this Project was previously fully analyzed and considered as part of the 2014 Centennial General Plan EIR (SCH No. 2013041021), and none of the conditions set forth in Public Resources Code section 21166 or CEQA Guidelines section 15162 apply that would require the City to prepare subsequent or supplemental environmental analyses of the Project. There are no changes to the Project, the circumstances surrounding the Project, or new information that indicate that the Project would have any new or more severe environmental impacts beyond those which were analyzed in the 2014 EIR. Additionally, based on the record as a whole, the project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of minor alteration of existing public structures, facilities, or topographical features, involving negligible or no expansion of existing or former use.

SECTION 3. That a supplemental appropriation in the amount of $848,900 from the Gas Tax Fund into Account No. 012-861-45300-000-11308 is hereby approved.

SECTION 4. That the Construction Contract Agreement for the South El Camino Real Lane Reconfiguration and Buffered Bike Lane Project, Federal Project No. CML-5274(039), FTIP No. ORA 190914, City CIP Project No. 11308, is hereby awarded to ONYX Paving Company, Inc.

SECTION 5. That the City Manager is authorized and directed to execute a construction contract for the South El Camino Real Lane Reconfiguration & Buffered Bike Lane Project, Federal Project No. CML-5274(039), FTIP No. ORA 190914, City CIP Project No. 11308 with ONYX Paving Company, Inc. in an amount not to exceed $1,639,000, in a form substantially similar to that presented to City Council on April 15, 2025.

SECTION 6. That a 10% project contingency of $163,900 is hereby approved and may be used to the extent deemed necessary and advisable by the City Manager.

SECTION 7. That the City Manager or his designee is authorized and directed to execute such other documents and take such other and further actions as may be necessary and proper to accomplish the purposes of this resolution.

SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
