RESOLUTION NO. 25-67
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A COOPERATIVE PURCHASE CONSTRUCTION CONTRACT TO G2 CONSTRUCTION, INC. FOR THE EL CAMINO REAL CORRIDOR RUNOFF TREATMENT PROJECT IN AN AMOUNT NOT TO EXCEED $410,000, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT, AUTHORIZING A RELATED APPROPRIATION AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, the City of San Clemente owns and operates a Municipal Separate Storm Sewer System (MS4) for the purposes of separating stormwater flows from the collection of municipal wastewater and protecting infrastructure and private property; and WHEREAS, under the National Pollutant Discharge Elimination System (NPDES), the City must comply with the conditions of a valid permit for discharges from its MS4, specifically, Order Number R9-2013-0001, as amended by Order Nos. R9-2015-0001 and R9-2015-0100, issued and enforced by the San Diego Regional Water Quality Control Board (“MS4 permit”); and WHEREAS, the City also must comply with the 2015 Trash Amendments to the MS4 permit, which require full capture of trash greater than 5 mm in diameter in all high-traffic Priority Land Use areas; and WHEREAS, the City intends to accomplish compliance with the Trash Amendments by “piggybacking” on the County of Orange Master Agreement with G2 Construction, Inc., which was executed for the purpose of assisting cities with such compliance, and which is permissible under California Public Contract Code section 10299 and Section XI(A)(1.4) of City Procurement Policy and Procedure No. 201-2-1; and WHEREAS, the City finds that G2 Construction, Inc. can provide quality catch basin inserts at fair pricing and in a manner eligible for the $328,000 in previously awarded Orange County Transportation Authority (OCTA) Environmental Cleanup Program grant funding; and WHEREAS, the City’s Clean Ocean Fund has $87,500 in additional funding available in the FY 2025-26 budget to support the grant-required 20% local match.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repair of existing public facilities involving no expansion of an existing use.
SECTION 3. That an appropriation of $328,000 from an OCTA Environmental Cleanup Grant to Account No. 057-543-43690-000-26802 is hereby authorized.
SECTION 4. That an exemption to competitive bidding requirements is hereby authorized and approved for and the construction contract for the El Camino Real Corridor Runoff Treatment Project, Project No. 26802, is awarded to G2 Construction, Inc. as a cooperative purchase agreement.
SECTION 5. That the City Manager is authorized and directed to execute a construction contract for the El Camino Real Corridor Runoff Treatment Project, Project No. 26802 with G2 Construction, Inc. in an amount not to exceed $410,000, in a form substantially similar to that presented to the City Council on May 20, 2025.
SECTION 6. That staff is hereby authorized and directed to take such actions as may be necessary and proper to accomplish the purposes of this resolution.
SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
