A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A THREE-YEAR PROFESSIONAL SERVICES AGREEMENT FOR WATER QUALITY ANALYSIS LABORATORY SERVICES TO SIERRA ANALYTICAL LABS, INC. WITH TWO OPTIONAL ONE-YEAR EXTENSION, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT IN AN AMOUNT NOT TO EXCEED $418,923 FOR THE INITIAL TERM AND OPTIONS NOT TO EXCEED CITY COUNCIL APPROVED BUDGETED AMOUNTS WHEREAS, the City's Water Reclamation Plant is required by State and Federal regulations to sample various constituents in the treated wastewater discharged to the ocean, as well as the recycled water delivered to irrigation customers in the City. Additionally, weekly, monthly, and annual analysis of potable water supplied to San Clemente customers is required by the State of California as well as the Environmental Protection Agency; and WHEREAS, the City’s Water Reclamation Plant laboratory conducts wastewater, recycled water, and limited potable water testing to meet regulatory requirements and to maintain compliance with the City’s various permits. The laboratory work for the City is conducted by a full time Laboratory Coordinator with a primary focus on wastewater and recycled water. To augment coverage during staff vacations, emergencies, weekends, and for the majority of potable water testing, which the City laboratory does not have the equipment or certification to perform, on-call, contracted laboratory services are necessary from an appropriately certified laboratory; and WHEREAS, the City entered into a contract with Sierra Analytical Labs, Inc. for laboratory services on June 18, 2019, which is set to expire on June 30, 2025; and WHEREAS, a Request for Proposals process was conducted for Water Quality Analysis Laboratory Services and only one (1) responsive proposal was received; and WHEREAS, after evaluation of the proposal received, and an interview conducted by City staff, Sierra Analytical Labs, Inc. is recommended for a new contract for Water Quality Analysis Laboratory Services, based on their experience working with other water agencies in Southern California, their significant work experience in performing water and wastewater laboratory services and analysis, familiarity and prior experience with the City, staff resources, a record of success providing laboratory services for the City over many years, and their fair and reasonable fee.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitals are true and correct and incorporated herein fully by reference.
SECTION 2. That a three-year Professional Services Agreement for Water Quality Analysis Laboratory Services with two optional one-year extensions is hereby awarded to Sierra Analytical Labs, Inc.
SECTION 3. That the City Manager is authorized and directed to execute a Professional Services Agreement with Sierra Analytical Labs, Inc. for an amount not to exceed $418,923 total over the initial three-year term in a form substantially similar to that presented to City Council on June 17, 2025.
SECTION 4. That the City Manager is authorized to approve up to two, one-year extensions to such Agreement that do not exceed the City Council approved budgeted amounts for each fiscal year.
SECTION 5. That the City Manager or his designee are authorized and directed to take such other and further actions as may be necessary and proper to fulfill the purposes of this resolution.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
