RESOLUTION NO. 25-94
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A PROFESSIONAL CONSULTANT SERVICES AGREEMENT TO CHEN RYAN ASSOCIATES, INC. FOR CALAFIA COMPLETE STREETS, CIP PROJECT NO. 15319, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT IN AN AMOUNT NOT TO EXCEED $279,196, ACCEPTING RELATED GRANT FUNDING OF $176,000, AND MAKING A SUPPLEMENTAL APPROPRIATION OF $149,196 WHEREAS, on October 3, 2023, City Council authorized staff to submit a grant funding application for complete streets improvements to Avenida Calafia; and WHEREAS, the City was awarded $176,000 for the design phase and $842,000 for the construction phase of the project which is subject to City fair share cost and Caltrans Local Assistance Manual (LAPM) requirements; and WHEREAS, on December 5, 2024, the Engineering Division solicited proposals from qualified firms to provide engineering consulting services for the Calafia Complete Streets, CIP Project No. 15319 (Project); and WHEREAS, on February 6, 2025, the City received seven (7) responsive proposals for the Project; and WHEREAS, City staff reviewed the submitted proposals, conducted oral interviews with the top three (3) ranked consultants and determined that Chen Ryan Associates, Inc. provided the best approach and team for the Project, was the most qualified to perform the services and its fee is fair and reasonable.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City hereby accept the federal Complete Streets Program grant for the Project Approval & Environmental Documents (PA&ED) and Plans, Specifications & Estimate (PS&E) project phases in the amount of $176,000 (Revenue Account No. 011-000-33180-000-15319).
SECTION 3. That a supplemental appropriation in the amount of $149,196 from the State SB-1 Road Maintenance Rehabilitation Account (RMRA) Funds to project expenditure Account No. 011-864-45300-000-15319 is hereby approved.
SECTION 4. That Chen Ryan Associates, Inc. is hereby determined to be the most qualified to perform the engineering consulting services needed for the Calafia Complete Streets, CIP Project No. 15319, and its fee is fair and reasonable.
SECTION 5. That the Professional Consulting Services Agreement is hereby awarded to Chen Ryan Associates, Inc. for engineering consulting services for the Calafia Complete Streets, CIP Project No. 15319.
SECTION 6. That the City Manager is authorized and directed to execute the Agreement for the Calafia Complete Streets, CIP Project No. 15319 with Chen Ryan Associates, Inc. in an amount not to exceed $279,196, in a form substantially similar to that presented to City Council on June 17, 2025.
SECTION 7. That the City Manager and/or Public Works Director/City Engineer are authorized to execute all necessary applications, tentative agreements, and/or other such documents/actions required to complete the design and permitting of the project with the California Coastal Commission, California State Parks, and any other necessary parties and to take such other and further action as is necessary and proper to accomplish the purposes of this resolution.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
